Representative Kathy Tingelstad, Chair of the Governmental Operations and Veterans Affairs Committee, called the forty eighth meeting to order at 10:30 AM on Tuesday, March 21, 2006, in Room 5 of the State Office Building.

The Clerk noted the roll.

HF3203 (Ruth) County state-aid highway fund screening board established, hazardous material transport minimum age provided, and postal rule distribution provision repealed.

Chair Tingelstad moved that HF3202 be recommended to pass and be placed on the General Register.

Chair Tingelstad moved the A06-1274 amendment.

Chair Tingelstad renewed her motion that HF3203 be recommended to pass and be placed on the General Register. THE MOTION PREVAILED AND THE BILL WAS PLACED ON THE GENERAL REGISTER.

HF3078 (Penas) Iron Range Resources and Rehabilitation Board composition and member selection provided.

Chair Tingelstad moved that HF3078 be recommended to pass and be placed on the General Register.

Representative McNamara moved to orally amend HF3078; however, it was not acted upon since HF3078 was temporarily laid over.

Chair Tingelstad temporarily laid over HF3078 until the evening meeting.

HF3380 (Buesgens) Post-employment benefit account establishment by political subdivisions for officers and employees authorized.

Chair Tingelstad moved that HF3380 be recommended to pass and be referred to the Committee on Local Government.

Chair Tingelstad moved to recess at 11:54 AM.
Chair Tingelstad resumed the meeting at 6:22 PM.
Chair Tingelstad brought up HF3078 from the morning meeting, to be recommended to pass and be referred to the Committee on State Government Finance.
Representative McNamara moved the H3078DE1 amendment.

Representative Kahn moved to orally amend H3078DE1 as follows:

Line 1.11, delete “2 each from the majority and minority caucuses” and insert “at least three of whom must represent the taconite assistance area defined in Minnesota statutes Section 273.1341”

Lines 1.12 to 1.13, delete “two each from the majority and minority caucuses” and insert “at least three of whom must represent the taconite assistance area defined in Minnesota statutes, section 273.1341”

Lines 1.13 to 1.14, delete “Governor must designate one of the members specified in clauses (1) to (4) to serve as chair” and insert “members must elect co-chairs, one of whom must be a legislator and one a citizen”

THE MOTION PREVAILED AND REPRESENTATIVE KAHN’S ORAL AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Representative McNamara renewed his motion on the H3078DE1 amendment as amended. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Tingelstad updated her original motion on HF3078 by inserting “without recommendation.”

Chair Tingelstad renewed her motion that HF3078 be passed as amended and be referred without
recommendation to the Committee on State Government Finance. THE MOTION PREVAILED AND THE BILL WAS REFERRED WITHOUT RECOMMENDATION TO THE COMMITTEE ON STATE GOVERNMENT FINANCE. Division was called. There were 7 AYES and 11 NAYES. THE MOTIONED FAILED.

HF3625 (Peppin) Public employee insurance provisions modified, and money appropriated.

Chair Tingelstad moved that HF3625 be recommended to pass and be referred to the Committee on Health Policy & Finance.

Representative Liebling moved to orally amend HF3625 as follows:

Delete Section 11, from line 6.22 through line 6.27

Representative Liebling withdrew her oral amendment.

Representative Liebling moved to orally amend HF3625 as follows:

Line 6.24, delete “from the health care access fund”

THE MOTION PREVAILED AND LIEBLING’S ORAL AMENDMENT WAS ADOPTED.

Representative Loeffler moved to orally amend HF3625 as follows:

Line 3.11, delete “limited benefit plans”

THE MOTION FAILED.

HF3187 (Peppin) Per diem payments to legislators prohibited during certain special sessions.

Representative Seifert moved that HF3187 be recommended to pass and be referred to the Committee on State Government Finance.

Representative Hosch moved to orally amend HF3187 as follows:

Page 1, line 1.22, after “session” insert “in an odd-numbered year”

Page 1, delete line 1.23 and insert “the primary bill establishing state tax policy, and the primary bill making appropriations in each of the following areas: higher education; early childhood through high school education; agriculture and rural development; environment and natural resources; health and human services; state government finance; economic development; public safety; and transportation. A member must not receive per diem living expenses during a special session that is called in an even-numbered year because the legislature failed to pass a bill making appropriations for capital investment during the regular session”

THE MOTION PREVAILED AND REPRESENTATIVE HOSCH’S ORAL AMENDMENT WAS ADOPTED.

Representative Seifert updated his original motion to add “without recommendation”

Representative Seifert renewed his motion that HF3187 be passed as amended and referred without recommendation to the Committee on State Government Finance. THE MOTION PREVAILED AND THE BILL WAS REFERRED WITHOUT RECOMMENDATION TO THE COMMITTEE ON STATE GOVERNMENT FINANCE.

HF2890 (Sykora) Staggered terms of office for senators and staggered four-year terms of office for representatives provided, legislature size reduced, and constitutional amendment proposed.

Chair Tingelstad moved that HF2890 be recommended to pass and be referred to the Committee on Civil Law & Elections.

Representative Kahn moved to orally amend HF2890 as follows:

Delete Article 2; amend the title accordingly

THE MOTION PREVAILED AND REPRESENTATIVE KAHN’S ORAL AMENDMENT WAS ADOPTED.

Representative Loeffler moved to orally amend HF2890 as follows:

Page 1, delete lines 18 and 19; delete “, half the representatives from odd-number districts chosen in a manner provided by law, and half the” and insert “and”

Page 1, line 20, delete “chosen in a manner provided by law”

THE MOTION PREVAILED AND REPRESENTATIVE LOEFFLER’S ORAL AMENDMENT WAS ADOPTED.

HF3241 (Erickson) Final passage of bill or conference report on the day it is received by a body prohibited and certain exceptions provided.

Chair Tingelstad moved that HF3241 be recommended to pass and be placed on the General Register.

Representative Liebling moved to orally amend HF3241 as follows:

Page 1, lines 1.13 to 1.14, delete “, or by an executive order of the governor that refers
to the specific senate file number or house file number”

THE MOTION PREVAILED AND REPRESENTATIVE LIEBLING’S ORAL AMENDMENT WAS ADOPTED.

Chair Tingelstad updated her motion as follows:

Delete “placed on the General Register” and insert “referred to the Committee on
State Government Finance”

Representative Kahn moved to orally amend HF3241 as follows:

Delete subdivision 3, lines 1.20-1.22

THE MOTION PREVAILED AND KAHN’S ORAL AMENDMENT WAS ADOPTED.

Representative Demmer moved to orally amend HF3262 as follows:

Line 1.3, delete “on member’s desks” and insert “available”

Line 1.6, delete “ON MEMBERS’ DESKS” and insert “AVAILABLE”

Line 1.8, delete “written”; delete “placed on the desk of” and insert “made available
to”; insert “at least” after “each member of the house”
