Representative Jim Knoblach, Chair, called the forty-sixth meeting to order at 5:37 p.m. on Monday, May 1, 2006 in Room 200 of the State Office Building.

The Clerk noted the roll.

Representative Knoblach called the meeting to order at 5:37 p.m. A quorum was present.

Representative Buesgens moved that the minutes of April 27, 2006 be recommended to pass.
THE MOTION PREVAILED.

HF3116 McNamara , Third engrossment, Game and fish provisions modified.

Representative McNamara, Bob Meier, Legislative Affairs, Minnesota Department of Natural Resources, and Ed Boggess, Fish and Wildlife Policy Chief, Minnesota Department of Natural Resources testified on HF3166, third engrossment.

Representative McNamara moved that HF3116, third engrossment, be recommended to pass.

Representative McNamara moved the A06-1647 amendment. THE AMENDMENT WAS ADOPTED.

Representative McNamara moved that HF3116, third engrossment, be recommended to pass. THE MOTION PREVAILED.

HF3058 Penas and Sertich , First engrossment, Iron Range Resources and Rehabilitation Board fund expenditure approval process clarified, land lease authorized, long-range plan required, and money appropriated.

Representative Sertich testified on HF3058, first engrossment.

Representative Knoblach moved that HF3058, first engrossment be recommended to pass.

Representative Knoblach moved the H3058A2 amendment.

Representative Rukavina moved to orally amend HF3058, first engrossment by: P.5, L.11, before “49,000,000” insert on “July 1, 2007”

HF3058, FIRST ENGROSSMENT, WAS LAID OVER.

SF930 Brod, Compulsive gambling prevention and education funding provided, and money appropriated.

Representative Knoblach moved that SF930 be recommended to pass.

Representative Brod and Doug Faney, Regional and Planning Director, Minnesota State Lottery, and testified on SF930.

Representative Knoblach moved to orally amend SF930 by; P.1, L.16, after the period insert: “These are one time appropriations.” THE ORAL AMENDMENT WAS INCORPORATED.

Representative Knoblach moved that SF930, as amended, be recommended to pass. On a division of 11 AYES and 3 NAYS THE MOTION PREVAILED.

HF3253, Hackbarth, First engrossment Bar bingo and pull-tab game requirements modified.

Representative Knoblach moved that HF3253, first engrossment, be recommended to pass.

Representative Hackbarth and King Wilson, Executive Director, Allied Charities of Minnesota, testified on HF3253.

Representative Knoblach renewed his motion that HF3253, first engrossment, be recommended to pass. THE MOTION PREVAILED.

HF3254 Hackbarth, Second engrossment, Sports-themed tipboard game pilot project authorized.

Representative Knoblach moved that HF3254, second engrossment, be recommended to pass.

Representative Hackbarth testified on HF3254, second engrossment.

Representative Knoblach renewed his motion that HF3254, second engrossment, be recommended to pass. THE MOTION PREVAILED.

HF3144 Bradley, Assisted living services requirements established, procedures specified, and home care provider categories modified.

Representative Bradley moved that HF3144 be recommended to pass.

Representative Bradley testified on HF3144.

Representative Bradley moved the H3144DE3-2 amendment. THE AMENDMENT WAS ADOPTED.

Representative Bradley moved the H3144A6 amendment. THE AMENDMENT WAS ADOPTED.

Representative Otremba moved the HAD-822 amendment.

Representative Otremba moved to orally amend the HAD-822 amendment by: P.1, L.1.2, change, “17” to “18”, change “12” to “8”, L. 1.3, change “18” to ‘15” THE ORAL AMENDMENT WAS INCORPORATED.

Representative Bradley raised a point of order under committee rule 4 that the HAD-822 amendment was not germane to HF3144.

Representative Knoblach, after advice, ruled that the point of order was well taken and that the HAD-822 amendment was not germane to HF3144.

Representative Kelliher appealed the ruling of the Chair and asked for a roll call. The results were as follows:

On a vote of 15 AYES and 12 NAYS THE RULING OF THE CHAIR WAS UPHELD.

Representative Bradley moved that HF3144, as amended, be recommended to pass. THE MOTION PREVAILED.

The meeting was adjourned at 8:15 p.m.
