Representative Loren Solberg, Chair of the Committee on Ways and Means, called the meeting to order on Tuesday, April 27, 2010 at 5:45 PM in the Basement Hearing room.

The Committee Legislative Assistant noted the roll.

Representative Carlson moved to adopt the Minutes of April 21, 2010 as presented.

SF1537 (Clark) Energy facility definition amended.
Representative Carlson moved that SF1537 be recommended to pass and placed on the General Register.

Representative Clark presented SF1537.

Representative Carlson moved to amend SF1537 as follows: see S1537A12.
THE MOTION PREVAILED THE AMENDMENT WAS ADOPTED

Bill Glahn, Deputy Commissioner of Commerce testified on behalf of SF1537 as amended.

Rick Evans, Excel Energy testified on behalf of SF1537 as amended.
Representative Carlson renewed his motion that SF1537, as amended be recommended to pass and placed on the General Register.
THE MOTION PREVAILED

HF3033 (Rukavina) Spent nuclear fuel storage fee modified, rebate program established for solar photovoltaic modules, and money appropriated.
Representative Faust moved that HF3033 be recommended to pass and be placed on the General Register.

Representative Rukavina explained HF3033.

Representative Faust renewed his motion that HF3033 pass and be placed on the General Register.

SF2471HF2754 (Winkler) Secretary of state filings regulated.
Representative Solberg announced that SF2471 will be placed on the Agenda for Ways and Means on April 28, 2010.

HF3046 (Ruud) Birthing centers licensure established.
Representative Rudd moved that HF3046 be recommended to pass and be placed on the General Register.

Representative Rudd explained HF3046.

Representative Rudd moved to amend HF3046 as follows: See H3046A7.
THE MOTION PREVAILED THE AMENDMENT WAS ADOPTED

Representative Rudd to amend HF3046 as amended as follows: delete all of section 1.
THE MOTION PREVAILED THE AMENDMENT WAS ADOPTED

Representative Solberg moved to amend HF3046 as amended as follows: On page 6, after Section 6, insert Section 7 as follows:
Appropriation. $9,000 is appropriated from the state government special revenue fund to the Commissioner of Health for the purpose of this act.
THE MOTION PREVAILED THE AMENDMENT WAS ADOPTED

Representative Rudd renewed her motion that HF3046 as amended pass and be placed on the General Register.

HF3790 (Murphy) Funding provided from constitutionally dedicated funds and expenditure provided for expenditure accountability, administration, and governance of outdoor heritage, clean water, parks and trails, and arts and cultural heritage purposes; grants, programs, fees, and accounts modified and established, and money appropriated.

Representative Faust moved that HF3790 be recommended to pass and be placed on the General Register.

Representative Murphy explained HF3790.

Representative Faust moved to amend HF3790 as follows: see H3790A3 amendment.

Representative Faust moved to amend the A3 amendment as follows:
Line 1.2, delete line 24 and insert line 30
Line 1.3, delete the number 25 and insert the number 31, and delete the number 27 and insert the number 33
Line 1.4, delete Page 24, line 28 and insert Page 25, line 1.
THE MOTION DID NOT PREVAIL THE AMENDEMENT WAS NOT ADOPTED

Kent Lokkesmoe, Minnesota Department of Natural Resources, Division of Waters, testified on behalf of Representative Faust’s amendment.

Representative Faust renewed his motion to amend HF3790 as follows: SeeHF3790A3. A Roll Call vote was requested. The Clerk noted the roll:
Members voting AYE: Abeler, Davids, Demmer, Eken, Faust, Hamilton, Holberg, McNamara, Otremba, Tillberry.

Members voting NAY: Solberg, Brynaert, Bunnk, Carlson, Hilstrom, Kahn, Lenczewski, Mariani, Nelson, Rudd, Scalze.

There being 10 AYES and 11 NAYS:
THE MOTION DID NOT PREVAILED THE AMENDMENT WAS NOT ADOPTED

Representative Faust moved to amend HF3790 as follows: See H3790A4.
Representative Faust moved an oral amendment to H3790A4 as follows: on line 1.2 delete line 23, and insert line 29.
THE MOTION PREVAILED THE AMENDMENT WAS ADOPTED

A roll call vote was requested. The Clerk noted the roll.
Members voting AYE: Abeler, Davids, Demmer, Eken, Faust, Hamilton, Holberg, McNamara, Otremba, Westrom.

Representative Eken withdrew his amendment to HF3790: See H3790A8

Jim Nobles, Legislative Auditor testified on behalf of HF3790.

Representative Faust renewed his motion that HF3790 pass and be placed on the General Register.
THE MOTION PRREVAILED

HF2562 (Thissen) COBRA premium state subsidy eligibility extended, unexpected funds carry forward authorized for COBRA grants, and appropriations changed.

Representative Rudd moved that HF2562 be recommended to pass and be placed on the General Register.

Representative Thissen explained HF2562.

Representative Rudd renewed her motion that HF2562 pass and be placed on the General Register.
