CIVIL JUSTICE POLICY COMMITTEE MINUTES
Representative Mullery, Chair, called the meeting to order at 8:40 A.M. on Wednesday, February 24, 2010, in Room 10 of the State Office Building.
The Legislative Assistant noted the roll.

Representative Kulick-Jackson moved approval of the Minutes for Monday, February 22, 2010. THE MOTION PREVAILED.
Chair Mullery announced that this would be an informational hearing only. Explanations of the tenant/landlord bills before the committee will be given and testimony provided. Representatives of tenants and landlords will continue to work together to create a bill that the committee will consider at a future meeting.

Representative Mullery and Larry McDonough of Legal Aid Society of Minneapolis, provided an explanation of his bill:
H.F. 2668 (Mullery): A bill for an act relating to landlord and tenant; modifying certain procedures related to expungement in eviction cases; adding certain residential covenants; specifying procedures for handling applicant screening fees; providing certain rights to tenants of foreclosed properties; amending Minnesota Statutes 2008, sections 484.014, subdivision 3, by adding a subdivision; 504B.161, subdivision 1; 504B.173; 504B.178, subdivision 7; 504B.285, by adding a subdivision; Minnesota Statutes 2009 Supplement, section 504B.285, subdivision 1; proposing coding for new law in Minnesota Statutes, chapter 504B.

Larry McDonough provided an explanation of the following bills:
H.F. 2985 (Clark): A bill for an act relating to landlord and tenant; prohibiting imposition of a late fee except in specified circumstances; requiring a receipt for certain rent payments; permitting a tenant to make emergency repairs; modifying other laws related to a rental agreement; amending Minnesota Statutes 2008, sections 504B.111; 504B.178, by adding a subdivision; 504B.385, by adding a subdivision; proposing coding for new law in Minnesota Statutes, chapter 504B.
H.F. 2816 (Hayden): A bill for an act relating to landlord and tenant; modifying certain provisions related to utilities; permitting termination of a lease for medical reasons; modifying provisions related to eviction; amending Minnesota Statutes 2008, sections 504B.215, subdivisions 2, 2a, 3, 4; 504B.241, subdivision 4; 504B.265; 504B.291, by adding a subdivision; 504B.321, subdivision 1; 504B.385, subdivision 1; 504B.395, subdivision 4; Minnesota Statutes 2009 Supplement, section 504B.285, subdivision 1.
Representative Champion provided an explanation of his bill:
H.F. 2829 (Champion): A bill for an act relating to landlord tenant law; modifying provisions related to expungement of eviction records; providing access to a unit for the personal representative of deceased tenant; amending Minnesota Statutes 2008, sections 484.014, subdivisions 2, 3, by adding subdivisions; 504B.225; 504B.231; 504B.375, subdivisions 1, 2, 5.
