CIVIL JUSTICE POLICY COMMITTEE MINUTES



Representative Kulick-Jackson, Vice Chair, called the meeting to order at 8:38 A.M. on Wednesday, March 3, 2010, in Room 10 of the State Office Building.

The Legislative Assistant noted the roll.

H.F. 3139 (Bigham): A bill for an act relating to privacy; reinstating authority for release of financial records in response to a subpoena; amending Minnesota Statutes 2009 Supplement, section 13A.02, subdivision 1.

Representative Hilstrom moved the bill before the committee and moved that H.F. 3139 be recommended to pass and when so passed be placed on the General Register.

Representative Bigham presented her bill.

Representative Hilstrom renewed her motion. THE MOTION PREVAILED.

H.F. 1396 (Paymar): A bill for an act relating to domestic abuse; authorizing courts to include pets and companion animals in protective orders; amending Minnesota Statutes 2008, section 518B.01, subdivisions 6, 7.

Representative Paymar moved that H.F. 1396 be recommended to pass and when so passed be re-referred to the Committee on Public Safety Policy and Oversight.

Representative Paymar presented his bill.

H.F. 2996 (Mullery): A bill for an act relating to civil actions; requiring notice and other actions before a civil action or arbitration proceeding may be commenced to collect a purchased debt; regulating default judgments; providing criminal penalties; proposing coding for new law in Minnesota Statutes , chapter 544.

Representative Mullery moved that H.F. 2996 be recommended to pass and when so passed be placed on the General Register.

Representative Mullery presented his bill.

Representative Mullery moved adoption of the H2996A1 amendment. THE MOTION PREVAILED.

Representative Mullery moved adoption of the H2996A2 amendment. THE MOTION PREVAILED.

H.F. 1182, the First Engrossment (Bly): A bill for an act relating to eminent domain; clarifying use of eminent domain authority by public service corporations; amending Minnesota Statutes 2008, sections 117.225; 216E.03, subdivision 7; Minnesota Statutes 2009 Supplement, section 117.189.

Representative Westrom moved the bill before the committee and moved that H.F. 1182, the First Engrossment, be recommended to pass and when so passed be placed on the General Register.

Representative Westrom moved adoption of the A10-2199 amendment. THE MOTION PREVAILED.
