CRIME VICTIMS & CRIMINAL RECORDS DIVISION
MINUTES
Representative John Lesch, Chair of the Crime Victims & Criminal Records Division, started the second meeting at 8:40 am on Friday, January 30, 2009 in Room 5 of the State Office Building. A quorum was present and the meeting was called to order.
The Committee Legislative Assistant noted the roll.

Agenda/ Action:
Chair Lesch noted that Representative Bigham has been replaced on the committee by Representative Michael Paymar.
Chair Lesch called for a motion to approve the minutes of January 16, 2009.
Rep. Kath moved to approve the minutes of January 16, 2009.
THE MOTION PREVAILED AND THE MINUTES WERE ADOPTED.
HF139 (Doty): Domestic violence awareness month designated for month of October.
Rep. Olin moved that HF139 be recommended to pass and be returned to the Public Safety Policy and Oversight Committee.
Rep. Doty presented HF139 and took questions from the committee.
The following individuals testified on behalf of HF139 and took questions from the committee:
Cyndi Cook, Minnesota Coalition for Battered Women
Johnnie Barthel, advocate and citizen of Staples, Minnesota
Rep. Olin renewed his motion that HF139 be recommended to pass and be returned to the Public Safety Policy and Oversight Committee.
THE MOTION PREVAILED AND THE BILL WAS PASSED.
HF254 (Thissen): Law enforcement required to provide violent crime alerts to citizens who request notification, and crime alerts required to be distributed in a format that disabled citizens can access.
Rep. Thissen presented HF254 and took questions from the committee.
Chair Lesch announced a recess until 9:10am.
Chair Lesch assumed the gavel at 9:11am.
Rep. Kath moved that HF254 be recommended to pass and be returned to the Public Safety Policy and Oversight Committee.
Rep. Thissen took additional questions from the committee.
Clarence Schadegg, citizen of Richfield, MN, testified on behalf of HF254 and took questions from the committee.
Rep. Shimanski moved to orally amend HF254 as follows:
Delete page 1, line 1 through page 1, line 19;
Page 1, line 20: delete everything before "A"
Page 1, line 20: before "A" insert "If"
Page 1, line 20: after "agency" insert "provides a crime alert to citizens within its jurisdiction"
Page 1, line 20: strike "must provide"
Page 1, line 22: delete "deems appropriate"
Page 1, line 22: insert "," before "The"
THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS ADOPTED.
Rep. Kohls moved to amend HF254, as amended, as follows:
Page 1, line 23: after the period, insert:
"Any contact information provided by a citizen requesting a crime alert pursuant to this section is classified as private data on individuals."
Laurie Beyer- Kropuenske, Minnesota Department of Administration, testified on HF254 and to the proposed amendment.
Rep. Kohls renewed his motion to amend HF254, as amended.
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.
Rep. Kath renewed his motion that HF254 be recommended to pass as amended, and be returned to the Public Safety Policy and Oversight Committee.
THE MOTION PREVAILED AND THE BILL WAS PASSED.
The meeting was adjourned at 9:30 am.
