MINUTES



Representative John Lesch, Chair of the Crime Victims & Criminal Records Division, started the eighth meeting at 8:35 am on Friday, February 19, 2010 in the Basement of the State Office Building. A quorum was present and the meeting was called to order.

The Committee Legislative Assistant noted the roll.

Agenda/ Action:

Chair Lesch called for a motion to approve the minutes of the following meetings:

March 26, 2009
August 26, 2009
September 22, 2009
October 7, 2009
October 29, 2009

Rep. Paymar moved to approve the minutes of the preceding dates.
THE MOTION PREVAILED AND THE MINUTES WERE ADOPTED.

HF2608 (Hilstrom): Protection area extended to a reasonable area around residence or dwelling in ex parte orders for protection.

Rep. Hilstrom moved that HF2608 be recommended to pass and be re-referred to the Public Safety Policy & Oversight Committee.

Rep. Hilstrom presented HF2608 and took questions from the committee.

The following individuals testified in support of HF2608 and took questions from the committee:

Matthew Frank, Minnesota Attorney General’s Office
Vanessa Foster, Legal Advocate, Tubman Organization
Liz Richards, MN Coalition for Battered Women

Rep. Hilstrom renewed her motion that HF2608 be recommended to pass and be re-referred to the Public Safety Policy & Oversight Committee.
THE MOTION PREVAILED. THE BILL WAS PASSED.

HF2864 (Gardner): Domestic abuse offenders electronic monitoring pilot project authorized.

Rep. Olin moved that HF2864 be recommended to pass and be re-referred to the Public Safety Policy & Oversight Committee.

Rep. Olin moved to orally amend HF2864 as follows:

Page 1, Line 20, after "domestic abuse" insert ", to assure that electronic monitoring data are only used to protect victims,"
THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS ADOPTED.

Rep. Gardner presented HF2864 as amended, and took questions from the committee.

Liz Richards, MN Coalition for Battered Women, testified in support of HF2864 as amended and took questions from the committee.
Rep. Olin moved to orally amend HF2864, as amended, as follows:

Page 1, Line 18, after "prosecutors," insert "public defenders,"
THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS ADOPTED.

Rep. Olin renewed his motion that HF2864, as amended, be recommended to pass and be re-referred to the Public Safety Policy & Oversight Committee.
THE MOTION PREVAILED. THE BILL WAS PASSED.

The meeting was adjourned at 9:18 am.
