MINUTES



Representative Ron Shimanski, Vice-Chair of the Crime Victims & Criminal Records Division, started the fifth meeting at 8:33 am on Friday, March 13, 2009 in Room 5 of the State Office Building. A quorum was present and the meeting was called to order.

The Committee Legislative Assistant noted the roll.

Agenda/ Action:

Chair Lesch called for a motion to approve the minutes of February 27th, 2009, and noted that the minutes should be corrected to read for "February 27, 2009" and not "February 7, 2009".

Rep. Kath moved to approve the corrected minutes of February 27, 2009.
THE MOTION PREVAILED AND THE MINUTES WERE ADOPTED.

HF1245 (Simon): Domestic abuse provisions modified, definitions expanded, and no contact orders expanded to apply throughout the state.

Rep. Olin moved that HF1245 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Simon presented HF1245 and took questions from the committee.

Michelle Jacobson, Minneapolis City Attorney’s Office, testified on behalf of HF1245 and took questions from the committee.

Susan Segal, Minneapolis City Attorney’s Office, testified on behalf of HF1245 and took questions from the committee.

Rep. Olin renewed his motion that HF1245 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

Chair Lesch assumed the gavel at 8:54am.

HF1273 (Rosenthal): domestic abuse arrest time expanded.

Rep. Kath moved that HF1273 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Rosenthal presented HF1273 and took questions from the committee.

Michelle Jacobson, Minneapolis City Attorney’s Office, testified on behalf of HF1273 and took questions from the committee.

Rep. Kath renewed his motion that HF1273 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF1546 (Rosenthal): Eliminating the requirement that a previous conviction be against a family or household member to enhance a domestic assault conviction.

Rep. Olin moved that HF1546 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Rosenthal presented HF1546 and took questions from the committee.

Rep. Olin renewed his motion that HF1546 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

HF1349 (Hilstrom): Victims of criminal sexual conduct required to receive information regarding orders of protection and restraining orders.

Rep. Hilstrom moved that HF1349 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Hilstrom presented HF1349 and took questions from the committee.

Suzanne Elwell, Office of Justice Programs, Minnesota Department of Public Safety, testified in support of HF1349 and took questions from the committee.

Rep. Hilstrom renewed her motion that HF1349 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

Vice-Chair Shimanski assumed the gavel at 9:06am.

HF1199 (Lesch): Felony domestic assault and domestic assault by strangulation defined as crimes of violence.

Rep. Loon moved that HF1199 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Lesch presented HF1199 and took questions from the committee.

Tom Adkins, Minnesota Association of Community Corrections Act Counties, testified in support of HF1199 and took questions from the committee.

Rep. Loon renewed her motion that HF1199 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF1392 (Lesch): Omnibus sexual conduct technical review bill provided.

Rep. Lesch moved that HF1392 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Lesch presented HF1392 and took questions from the committee.

The following individuals testified in support of HF1392 and took questions from the committee:

Cory Tennison, Scott County Assistant Attorney

Rep. Lesch moved to amend HF1392 (see H1392A1).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Suzanne Alliegro, Minnesota Sentencing Guidelines Commission, testified on HF1392 and took questions from the committee.

Rep. Lesch renewed his motion that HF1392 be recommended to pass as amended and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF1120 (Kath): comprehensive incident-based reporting system data use delineated.

Rep. Kath moved that HF1120 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.

Rep. Kath presented HF1120 and took questions from the committee.

Chair Lesch assumed the gavel at 9:28am.

David Johnson, Minnesota Justice Information Services, testified on behalf of HF1120 and took questions from the committee.


Rep. Kath renewed his motion that HF1120 be recommended to pass and be returned to the Committee on Public Safety Policy & Oversight.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF1119 (Kath): Bureau of Criminal Apprehension; statutes amended to reflect organizational changes.

Rep. Kath moved that HF1119 be recommended to pass and be returned to the Public Safety Policy & Oversight Committee.

Rep. Kath moved to orally amend HF1119 as follows:
Page 6, line 2, delete the first "13.873" and insert "13.87"
THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS ADOPTED.

David Johnson, Minnesota Justice Information Services, testified on behalf of HF1119 and took questions from the committee.

Rep. Kath renewed his motion that HF1119 be recommended to pass as amended and be returned to the Public Safety Policy & Oversight Committee.
