MINUTES
Representative Carlos Mariani, Chair of the K-12 Education Policy & Oversight Committee, called the twenty-second meeting to order at 8:40 AM on Thursday, March 5, 2009 in the basement hearing room of the State Office Building.

Rep. McFarlane moved the minutes from March 3, 2009, and March 4, 2009 be adopted. THE MOTION PREVAILED. THE MINUTES WERE ADOPTED.
HF920 (Tillberry)—A bill for an act relating to education; removing obsolete and unneeded mandates; amending Minnesota Statutes 2008, section 123B.143, subdivision 1; repealing Minnesota Statutes 2008, sections 120B.39; 122A.628; 122A.75.
Chair Mariani moved that HF920 be recommended to pass and referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division.
Chair Mariani moved the
H0920A3 amendment.
Rep. Tillberry presented HF920 and the H0920A3 amendment.
Rep. Abeler moved to divide the H0920A3 amendment.
Rep. Abeler withdrew his motion to divide the H0920A3 amendment.
Chair Mariani renewed his motion that the H0920A3 amendment be adopted. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.
Rep. Tillberry presented HF920, as amended.
Questions and discussion followed.
Ms. Lisa Larson, House Research, clarified some provisions of HF920, as amended.
Ms. Sandy Neren, Minnesota Newspapers Association, testified to HF920, as amended.
Chair Mariani moved the following oral amendment to the H0920A3 amendment, as adopted, as follows:
Page 7, Line 15 and 16, delete the new language.
Page 7, Line 15, after "publish" insert "a summary of"
Questions and discussion followed.
Chair Mariani withdrew the oral amendment as staff worked out the language.
Chair Mariani moved the following oral amendment to the H0920A3 amendment, as adopted, as follows:
Page 7, Line 15, delete "either" and insert "a summary of" and delete "or" and insert "and"
THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.
Ms. Grace Kelliher, Minnesota School Board Association, and Ms. Sue Abderholden, Executive Director of the National Alliance on Mental Illness - Minnesota, testified to a provision of HF920, as amended.
Ms. Michelle Weber, Government Relations, Minnesota Department of Education, and Ms. Sue Abderholden, Executive Director of the National Alliance of Mental Illness - Minnesota, testified against a portion of HF920, as amended.
Rep. Doepke moved to amend the H0920A3 amendment, as adopted, as follows:
Delete sections 1 – 8
THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.
Chair Mairani renewed his motion that HF920, as amended, be recommended to pass and referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division. THE MOTION PREVAILED.
HF1037 (Swails) – A bill for an act relating to education; reducing mandates for home schools; amending Minnesota Statutes 2008, sections 120A.22, subdivisions 6, 11; 120A.24; 120A.26, subdivisions 3, 4, 5; 121A.15, subdivisions 3, 8; 123B,42, subdivision 1; 171.05, subdivision 2; 181A.05, subdivision 1; repealing Minnesota Statutes 2008, section 120A.26, subdivision 1, 2.
Rep. Swails moved HF1037 be recommended to pass and referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division.
Ms. Atheen Johnson, parent, testified on behalf of HF1037.
Chair Mariani laid HF1037 over.
