MINUTES



Debra Hilstrom, Chair of the Public Safety Policy & Oversight Committee, started the tenth meeting of the House Public Safety Policy & Oversight Committee at 1:00 pm on Thursday, February 12, 2009 in Room 10 of the State Office Building.


The Committee Legislative Assistant noted the roll.

Agenda:


HF582 (Lesch): Defendant waiver of jury trial requirement changed.

Rep. Lesch presented HF582 and took questions from the committee.

A quorum was present at 1:04 and the meeting was officially called to order.

Rep. Lesch moved that HF582 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

The following individuals testified in support of HF582:

Chuck McLean, Winona County Attorney
Paul Young, Anoka county Attorney

The following individuals testified in opposition to HF582:

William Ward, Board of Public Defense
Bob Sicoli, Minnesota Association of Criminal Defense Lawyers

Rep. Lesch renewed his motion that HF582 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Chair Hilstrom laid HF582 over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

HF134 (Garafolo): Careless driving resulting in death classified as a gross misdemeanor.

Rep. Bigham moved that HF134 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.
Rep. Garafolo presented HF134 and took questions from the committee.

HF45 (Bigham): Penalty provided for careless driving resulting in death, and providing for revocation of violator’s driver’s license.

Rep. Bigham moved that HF45 be recommended to pass and be re-referred to the Finance Committee with a recommended re-referral to the Public Safety Finance Division.

Rep. Bigham presented HF45 and took questions from the committee.

John Hausladen, Minnesota Trucking Association

Rep. Bigham renewed her motion that HF45 be recommended to pass and be re-referred to the Finance Committee with a recommended re-referral to the Public Safety Finance Division.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

Rep. Bigham renewed her motion that HF134 be laid over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Chair Hilstrom laid HF134 over for possible inclusion in the Public Safety Policy & Oversight omnibus bill.

Chair Hilstrom announced a reminder of the scheduled prison facilities tour for Friday, February 13, 2009.

Chair Hilstrom called for a motion to approve the minutes of February 10, 2009.

Rep. Lesch moved that the minutes of February 10, 2009 be adopted.
THE MOTION PREVAILED AND THE MINUTES WERE ADOPTED.



The meeting was adjourned at 2:30 pm.
