MINUTES

A quorum was present and Representative Erickson, Chair of the Education Reform Committee, called the meeting to order at 8:17 AM on February 9, 2012, in the Basement Hearing Room of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Benson moved that the minutes from the committee meeting on January 31, 2012, be approved. THE MOTION PREVAILED AND THE MINUTES WERE APPROVED.

Representative Murdock moved that the minutes from the committee meeting on January 26, 2012, be approved. THE MOTION PREVAILED AND THE MINUTES WERE APPROVED.

HF 1870 (Petersen, B.) School districts authorized to base leave of absence and discharge decisions on teacher evaluation outcomes.

Representative Petersen moved that HF 1870 be recommended to pass, as amended, and sent to the general register. Representative Petersen moved the H1870A2 amendment, presented it and stood for questions. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Petersen moved the H1870A15 amendment, presented it and stood for questions. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Petersen moved the H1870A16 amendment, presented it and stood for questions. THE AMENDMENT WAS LAID OVER.

Representative Petersen moved the H1870A17 amendment, presented it and stood for questions.

The committee heard testimony on the bill.

Representative Petersen, B., requested a roll call. Representative Petersen withdrew the request for a roll call. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Davnie moved to send the bill to the Committee on Civil Law and requested a roll call.

THERE BEING 9 AYES AND 12 NAYES THE MOTION DID NOT PREVAIL AND THE MOTION WAS NOT ADOPTED.

Representative Petersen moved the H1870A19 amendment, presented it and stood for questions.

A technical amendment to the amendment was incorporated: Page 1, line 1.6, delete "must" and insert "most" in its place.

THE MOTION PREVAILED AND THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Representative Petersen moved the H1870A20 amendment, presented it and stood for questions. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Petersen moved the H1870A16 amendment, presented it and stood for questions. The author moved the following oral amendment to the amendment:

Delete page 1, lines 1.3-1.10, and insert:

1.3 Page 2, line 35, delete "or to a substantially different grade level assignment"
1.4 Page 3, line 3, delete "A"
1.5 Page 3, delete lines 3 and 4
1.6 Page 4, line 6, delete "or to a substantially different grade level assignment"
1.7 Page 4, line 8, delete everything after the period
1.8 Page 4, delete line 9
1.9 Page 7, line 15, delete "or to a"
1.10 Page 7, line 16, delete "substantially different grade level assignment"
1.11 Page 7, line 17, delete "A substantially"
1.12 Page 7, delete lines 18 and 19

THE MOTION PREVAILED AND THE AMENDMENT TO THE AMENDMENT WAS ADOPTED.

Representative Kath offered an oral amendment to the H1870DE4 amendment.

The amendment is as follows:

Page 2, line 2.29, insert "Notwithstanding the three-year professional review cycle, a teacher who receives an unrequested leave of absence notice has the right to have a summative evaluation performed in the same school year the teacher receives the notice."
Page 3, line 3.9, insert "EFFECTIVE DATE. The section is effective for the 2016-2017 school year and later."
Page 4, line 4.29, insert "Notwithstanding the three-year professional review cycle, a teacher who receives a discharge or demotion notice has the right to have a summative evaluation performed in the same school year the teacher receives the notice."
Page 5, line 5.9, insert "EFFECTIVE DATE. This section is effective for the 2016-2017 school year and later."

REPRESENTATIVE KATH WITHDREW THE AMENDMENT.

HF 1870 WAS LAID OVER.

HF 1542 (Eken) School start date exception made for school districts that suffer natural disasters.

Chair Erickson moved that HF 1542 be recommended to pass and sent to the general register.

Chair Erickson moved that HF 1542 be orally amended as follows:

Page 1, line 1.22: Delete "school" and insert "five" in its place.
Page 1, line 1.22: Delete "year" and insert "years" in its place.
Page 1, line 1.22: Delete ", tornado, or fire".

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Erickson renewed the motion that HF 1542 be recommended to pass, as amended, and sent to the general register. THE MOTION PREVAILED.

The meeting was recessed at 10:00 AM.

Chair Erickson called the meeting back to order at 6:06 PM.

Representative Petersen renewed his motion of the H1870A16 amendment. THE MOTION PREVAILED AND THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Representative Kath offered the H1870A18 amendment, presented it, and stood for questions. REPRESENTATIVE KATH WITHDREW THE AMENDMENT.

Chair Erickson renewed the motion that HF 1870, as amended, be recommended to pass and be placed on the general register. THE MOTION PREVAILED.
The meeting adjourned at 7:30 PM.
