MINUTES
Representative Denny McNamara, Chair of the Committee on Environment, Energy and Natural Resources Policy and Finance called the twenty-seventh meeting to order at 8:15 a.m. on March 10, 2011, in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present at 8:17 a.m.

H.F. 185 (Schomacker) Environmental violation monetary penalty deposit required to be redirected to general fund.

Representative Anderson moved H.F. 185 be laid over for possible inclusion in the Environment, Energy and Natural Resources Policy and Finance omnibus bill.

Rep. Schomacker presented H.F. 185.

Myrna Halbeck, Chief Financial Officer for the Minnesota Pollution Control Agency (PCA), and Jeff Connell, PCA Enforcement Office, testified on H.F. 185.

Representative Anderson renewed his motion that H.F. 185 be laid over for possible inclusion in the Environment, Energy and Natural Resources Policy and Finance omnibus bill.

Chair McNamara laid H.F. 185 over.

H.F. 434 (Hackbarth) Petroleum tank release cleanup fund eligibility modified, and sunset date extended.

Representative Hilty moved H.F. 434 be laid over for possible inclusion in the Environment, Energy and Natural Resources Policy and Finance omnibus bill.

Rep. Hackbarth presented H.F. 434.

Bob Krogman, MN Petroleum Marketers Association testified on H.F. 434.

Rep. Hilty renewed his motion that H.F. 434 be laid over for possible inclusion in the Environment, Energy and Natural Resources Policy and Finance omnibus bill.

Chair McNamara laid H.F. 434 over.

H.F. 197 (Hackbarth) Non-resident off-road vehicle state trail pass required.

Representative Hackbarth moved H.F. 197 be laid over for possible inclusion in the Environment, Energy and Natural Resources Policy and Finance omnibus bill.

Representative Hackbarth moved to orally amend H.F. 197 as follows:

Page 2, line 5 after "commissioner" remove "may", insert "shall".

THE MOTION PREVAILED. The amendment was adopted.

Bruce Gunderson, MN 4-Wheel Drive Association, and Ron Potter, Department of Natural Resources, Parks and Trails Division, testified on H.F. 197.

Rep. Hackbarth renewed his motion that H.F. 197 be laid over for possible inclusion in the Environment, Energy and Natural Resources Policy and Finance omnibus bill.

Chair McNamara laid H.F. 197 over.

Rep. Torkelson assumed the gavel at 9:25.

Boe Carlson, Three Rivers Park District, testified on H.F. 824.

Rep. Hackbarth renewed his motion that H.F. 824 be laid over for possible inclusion in the Environment, Energy and Natural Resources Policy and Finance omnibus bill.
