MINUTES
Representative Abeler, Chair of the Health and Human Services Finance Committee, called the meeting to order at 12:41 P.M. on March 10, 2011, in Room 200 of the State Office Building.
The Committee Legislative Assistant noted the roll.

Representative Hamilton moved that the minutes from the committee meeting on March 9, 2011, be approved. THE MOTION PREVAILED.
HF827 (Hamilton): Nursing facility equal rate provision sunset placed.
Representative Hamilton moved that HF827 be laid over for possible inclusion in the omnibus bill.
Representative Hamilton, and Bob Held, Nursing Facility Rates and Policy Director, Minnesota Department of Human Services, testified on HF827.
Chair Abeler laid HF827 over for possible inclusion in the omnibus bill.
HF828 (Hamilton): Nursing home rate equalization modified.
Representative Hamilton moved that HF828 be laid over for possible inclusion in the omnibus bill.
Representative Hamilton, Bob Held, Nursing Facility Rates and Policy Director, Minnesota Department of Human Services, Bob Dahl, President/CEO, Elim Care Inc., Jim Birchem, President/CEO, ElderCare of Minnesota, Karina Allen, Volunteer, AARP, Michele Kimball, State Director, AARP, Jane Ochrymowycz, Seniors and Workers for Quality Care, Al McAfee, Seniors and Workers for Quality Care, Amy McDonough, AARP, Carrie Thurlough, Aging Services of Minnesota, and Patti Cullen, Care Providers of Minnesota, testified on HF828.
Representative Hamilton moved the
H0828A2 amendment.
Representative Hamilton moved to incorporate the H0828A2 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Hamilton moved to incorporate the H0828A3 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Hamilton moved to incorporate the H0828A4 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.
Representative Schomacker moved the
H0828A5 amendment.
Representative Schomacker moved to orally amend the H0828A5 amendment, as follows:
Delete Section 3, "Lines 2.9 to 2.14". THE ORAL AMENDMENT WAS INCORPORATED INTO THE H0828A5 AMENDMENT.
Representative Hosch moved to orally amend the H0828A5 amendment, as follows:
Delete Section 6, "Lines 3.1 to 3.9".
Representative Hosch withdrew his oral amendment to HF0828A5.
HF835 (Hamilton): Low-payment rate nursing facilities medical assistance operating payment rates adjusted, and money appropriated.
Representative Hamilton moved that HF835 be laid over for possible inclusion in the omnibus bill.

H0835A1 amendment.
Representative Hamilton moved to incorporate the H0835A1 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.
Chair Abeler laid HF835, as amended, over for possible inclusion in the omnibus bill.
Representative Schomacker moved to orally amend the H0828A5 amendment, as follows:
Page 3, lines 8 and 9, delete "Employees of boarding care homes or nursing homes referenced in subdivision 6, paragraph ©, are not mandated reporters." and insert, "For purposes of reporting under this section for employees of certified boarding care homes and certified nursing homes referenced in subdivision 6, paragraph ©, federal reporting requirements meet state requirements."
Representative Schomacker moved to incorporate the H0828A5 amendment, as amended. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.
Chair Abeler laid HF828, as amended, over for possible inclusion in the omnibus bill.
