MINUTES
Representative Gunther, Chair of the Jobs and Economic Development Finance Committee, called the meeting to order at 12:35 p.m. on April 12, 2011, in Room 10 of the State Office Building.
The Committee Legislative Assistant noted the roll.

Representative Sanders moved approval of committee minutes of March 24, 2011. THE MOTION PREVAILED.
Representative Kieffer moved HF1362 (Workers' Compensation Advisory Council Recommendations Adopted) to pass and be re-referred to Ways & Means Committee.
Representative Kieffer moved to amend HF1362 as follows:
Line 10.5 - delete "are effective the day following final enactment" and
Insert - "is effective August 1, 2011." THE MOTION PREVAILED, AMENDMENT WAS ADOPTED.
Testifying before committee on behalf of the Mn Department of Labor and Industry was Commissioner Ken Peterson.
Representative Kieffer moved to amend HF 1362 as follows:
Insert after line 9.31 as follows:
"From the workers’ compensation fund for costs associated with implementing a case management system at the Office of Administrative Hearings. The Commissioner shall appropriate a sum not to exceed $600,000.00 from the Special Compensation Fund for the purposes of implementing a case management system and electronic filing system at the Office of Administrative Hearings. This is a onetime appropriation. Authority to disburse these funds is granted to the Chief Administrative Law Judge of the Office of Administrative Hearings." THE MOTION PREVAILED, AMENDMENT WAS ADOPTED.
Representative Kieffer renewed her motion that HF1362 pass, as amended, and be re-referred to Ways and Means. THE MOTION PREVAILED.
Representative Howes moved HF632 (Maintenance plumbers licensed, and fees modified) to pass and be re-referred to Ways and Means Committee.

Chair Gunther moved HF611 (Small business loan guarantee Program Created and Money Appropriated) to pass and be re-referred to the Commerce Committee.

Testifying before committee on behalf of the Mn Community Capitol Fund was Scott Martin, President, and on behalf of the City of Brooklyn Park was Amy Baldwin, Business Developer, and on behalf of Corporate Banking at Peoples Bank of Commerce in Edina was Greg Duscher, Vice President.
Chair Gunther renewed his motion that HF611 pass, as amended, and be re-referred to the Commerce Committee. THE MOTION PREVAILED.
Chair Gunther moved HF1170 (Worker classification regulation, penalties and fees modified) pass and be referred to Ways and Means Committee.
Testifying before committee on behalf of the Department of Labor and Industry was Assistant Commissioner Jessica Looman, and Charlie Durenberger, Enforcement Division, and on behalf of Employer Solutions Group was Chris Levine.
Representative Mahoney moved to amend HF1170 as follows:
Insert on Page 4, line 4.16 - $600.00. THE MOTION DID NOT PREVAIL, AMENDMENT WAS NOT ADOPTED.
Chair Gunther moved to amend HF 1170 as follows:
Insert on Page 4, line 4.16 - $2,000.00. THE MOTION PREVAILED, AMENDMENT WAS ADOPTED.
Chair Gunther renewed his motion that HF 1170 pass, as amended, and be re-referred to Ways and Means Committee. THE MOTION PREVAILED.
Chair Gunther moved HF1396 (Unemployment insurance and workforce development provisions modified) pass and be re-referred to Ways and Means Committee.

Testifying on behalf of the Department of Employment and Economic Development was Lee Nelson, Unemployment Insurance Advisor.
Testifying on behalf of the Minnesota Recruiting and Staffing Association was Jean Hamen, Director of Human Resources, and on behalf of Dolphin Temporary Services was Cindy Brooks.
Testifying on behalf of Low Income Legal Services was Jessica Webster, Staff Attorney.
Chair Gunther moved the
H1396A1 amendment.
Chair Gunther moved to amend H1396A1 as follows:
Page 2, Line 17 - delete "or",
Page 2, Lines 19-20 reinsert "; or"
Page 2, Line 21 reinsert "the employment is with a staffing service and less than 45 percent of the" and change "45" to "25".
Page 2, Line 22 reinsert "applicant’s wage credits are from a job assignment with the client of a staffing service."
Page 2, Line 23 reinsert "(h) A job assignment with a staffing service is considered suitable only if 45" and change "45 to "25",
Page 2, Lines 24 – 26 reinsert "percent or more of the applicant’s wage credits are from job assignments with clients of a staffing service and the job assignment meets the definition of suitable employment under paragraph (a)." THE MOTION PREVAILED, AMENDMENT WAS ADOPTED.
Chair Gunther moved
H1396A2 amendment, as amended. THE MOTION PREVAILED, AMENDMENT WAS ADOPTED.
