JUDICIARY POLICY AND FINANCE COMMITTEE

MINUTES

Representative Smith, Chair of the Judiciary Policy and Finance Committee, called the meeting to order at 8:18 A. M. on March 15, 2011, in Room 10 (Ground Floor) of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Wardlow moved approval of the March 10, 2011 Judiciary Policy and Finance Committee minutes. THE MOTION PREVAILED.

HF0998 (Dettmer) Human Cloning Prohibition Act established, and penalties provided.

Representative Smith moved HF0998 be recommended to pass and re-referred to the Health and Human Services Finance Committee.

Representative Smith moved the A11-0129 amendment. THE AMENDMENT WAS ADOPTED.

Representative Dettmer presented HF0998, as amended.

Jordan Bauer, Minnesota Citizens Concerned for Life, testified on HF0998, as amended.

Representative Smith renewed his motion that HF0998, as amended, be recommended to pass and re-referred the Health and Human Services Finance Committee. THE MOTION PREVAILED.

Representative Shimanski assumed the gavel at 8:32 A.M.

HF0556 (Smith) Juvenile prostitutes in need of protection or services provisions amended, sexually exploited youth defined, prostitution crime penalty assessments increased, and distribution of the assessment amended; prostitution laws provisions clarified and recodified, and definitions modified; money appropriated to the commissioner of public safety to develop a statewide victim services model.

Representative Smith moved HF0556 be recommended to pass and re-referred to the Ways and Means Committee.

Representative Smith presented HF0556.

Jeff Bauer, The Family Partnership, Jim Backstrom, Dakota County Attorney, Eric Werner, Burnsville Police Captain, Heather Boyun, Breaking Free participant, and Lisa Gagnier, Breaking Free participant, testified on HF0556.

Representative Gruenhagen moved to orally amend HF0556, Lines 5.31-6.3: doubling all fines, with the additional revenue being donated to fund programs that assist juvenile prostitutes.

Representative Gruenhagen withdrew his oral amendment.

Representative Shimanski laid over HF0556 for possible inclusion in an omnibus bill, or further action at a later time.

Representative Smith assumed the gavel at 9:00 A.M.

HF0868 (Shimanski) Conciliation court civil claim limit increased.

Representative Shimanski moved HF0868 be recommended to pass and re-referred to the Civil Law Committee.

Representative Shimanski presented HF0868.

Bruce Kleven, Cooperative Network, Tim Kavanaugh, Cooperative Network, and Ron Elwood, Legal Services Advocacy Project, testified on HF0868.

Representative Smith laid over HF0868 for possible inclusion in an omnibus bill, or further action at a later time.

Representative Shimanski assumed the gavel at 9:14 A.M.

HF0987 (Smith) Board of Public Defense reimbursement restrictions eliminated.

Representative Smith moved HF0987 be recommended to pass and placed on the General Register.

Representative Smith presented HF0987.

Kevin Kajer, Public Defense Board, testified on HF0987.

Representative Shimanski laid over HF0987 for possible inclusion in an omnibus bill, or further action at a later time.

HF0988 (Smith) Public defender representation provision modified.

Representative Shimanski moved HF0988 be recommended to pass and placed on the General Register.

Kevin Kajer, Public Defense Board, Steve Holmgren, 1st District Public Defenders, and Tim Kinley testified on HF0988.

Representative Shimanski laid over HF0988 for possible inclusion in an omnibus bill, or further action at a later time.

Representative Smith recessed the meeting at 10:00 A.M. until 4:30 P.M, or subject to the call of the Chair.

The meeting adjourned at 12:00 midnight.
