Representative Smith, Chair of the Judiciary Policy and Finance Committee, called the meeting to order at 8:19 A. M. on March 17, 2011, in Room 10 (Ground Floor) of the State Office Building.

Representative Mazorol moved approval of the March 15, 2011 Judiciary Policy and Finance Committee minutes. THE MOTION PREVAILED.
HF0382 (Hoppe) Statutes amended regarding receiverships and assignments for the benefit of creditors.
Representative Smith moved that HF0382 be recommended to pass and placed on the General Register.
Representative Hoppe presented HF0382.
Phil Kunkel, Minnesota State Bar Association, and Kevin Dunlevy, Minnesota State Bar Association, testified on HF0382.
Representative Smith renewed the motion that HF0382 be recommended to pass and re-referred to the General Register. THE MOTION PREVAILED.
HF0447 (Kelly) Investigation, review, and hearing governing provisions modified, crime of criminal abuse of a vulnerable adult made a registrable offense under the predatory offender registration law, terminology changed, criminal penalty increased for assaulting a vulnerable adult, and criminal penalties provided.
Representative Smith moved that HF0447 be recommended to pass and re-referred to the Civil Law Committee.

Iris Freeman, Center for Elder Justice and Policy, William Mitchell College of Law and
Kevin Hansen, Office of Ombudsman for Mental Health & Developmental Disabilities, testified on HF0447.
Representative Smith renewed the motion that HF0447 be recommended to pass and re-referred to the Civil Law Committee. THE MOTION PREVAILED.
HF0006 (Cornish) Criminal sexual conduct in the first degree penalty increased.
Representative Cornish moved that HF0006 be recommended to pass and re-referred to the Ways and Means Committee.

Sheriff Rich Stanek, Hennepin County, and Michael Freeman, Hennepin County Attorney, testified on HF0006.
Representative Smith laid over HF0006 for possible inclusion in an omnibus bill, or further action at a later time.
HF0718 (Champion) Civil rights restoration and civil rights possible loss notices required.
Representative Champion moved that HF0718 be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance Committee.
