1.3    "Sec. .... Minnesota Statutes 2022, section 144E.101, subdivision 12, is amended to read:
1.4    Subd. 12. Mutual aid agreement. (a) A licensee shall have a written agreement with
1.5at least one neighboring licensed ambulance service for the preplanned and organized
1.6response of emergency medical services, and other emergency personnel and equipment,
1.7to a request for assistance in an emergency when local ambulance transport resources have
1.8been expended. The response is predicated upon formal agreements among participating
1.9ambulance services. A copy of each mutual aid agreement shall be maintained in the files
1.10of the licensee and shall be filed with the board for informational purposes only.
1.11(b) A licensee may have a written agreement with a neighboring licensed ambulance
1.12service, including a licensed ambulance service from a neighboring state if that service is
1.13currently and remains in compliance with its home state licensing requirements, to provide
1.14part-time support to the primary service area of the licensee upon the licensee's request. The
1.15agreement may allow the licensee to suspend ambulance services in its primary service area
1.16during the times the neighboring licensed ambulance service has agreed to provide all
1.17emergency services to the licensee's primary service area. The agreement may not permit
1.18the neighboring licensed ambulance service to serve the licensee's primary service area for
1.19more than 12 up to 24 hours per day, provided service by the neighboring licensed ambulance
1.20does not exceed 108 hours per calendar week. This paragraph applies only to an ambulance
1.21service whose primary service area is mainly located outside the metropolitan counties listed
1.22in section 473.121, subdivision 4, and outside the cities of Duluth, Mankato, Moorhead,
1.23Rochester, and St. Cloud, or an ambulance based in a community with a population of less
1.24than 2,500 persons."
