1.6(a) An owner of a wind turbine issued a permit by the commissioner or a county board
1.7under this chapter, by the Department of Transportation under sections 360.81 to 360.91,
1.8or who is required by a political subdivision to install a light or lighting system
atop a wind
1.9turbine, must install a functioning aircraft detection lighting system atop the wind
turbine
1.10that meets the requirements for such systems in the current version of the Federal
Aviation
1.11Administration's Advisory Circular 70/760-1, Obstruction Marking and Lighting, as
updated.
1.12An aircraft detection lighting system installed on a wind turbine in this state must
be
1.13purchased from a vendor approved by the Federal Aviation Administration.
1.14(b) An owner of a wind turbine issued a permit or otherwise required to install a
light
1.15or lighting system atop a wind turbine before the effective date of this act must
comply with
1.16this act no later than December 31, 2019.
1.17(c) For the purposes of this section, "aircraft detection lighting system" means a
1.18sensor-based system that uses radio frequency to detect aircraft as they approach
an
1.19obstruction or group of obstructions, and automatically activates appropriate obstruction
1.20lights until they are no longer needed by the aircraft. An aircraft detection lighting
system
1.21may include an audio feature that transmits an audible warning message to provide
a pilot
1.22additional information on an obstruction the aircraft is approaching.
1.23EFFECTIVE DATE.This section is effective the day following final enactment."
