called to order by Irv Anderson, Speaker of the House.
Prayer was offered by Captain Mark W. Martsolf, The Salvation
Army, St. Paul, Minnesota.
The members of the House gave the pledge of allegiance to the
flag of the United States of America.

"Section 1. [FINDINGS.]
The legislature finds that in the absence of definitive empirical data demonstrating that the trend toward increasingly brief perinatal hospital stays as routine practice is safe, perinatal discharge of mothers and infants should be determined by the clinical judgment of attending health care providers and not by economic considerations. This decision should be made based on the criteria of medical stability, delivery of adequate predischarge education, need for neonatal screening, and determination that adequate feeding is occurring.
The legislature further finds that it is necessary and appropriate to regulate childbirth and postpartum care benefits to ensure that this care is provided in a manner consistent with this section and includes provisions for adequate psychosocial and medical follow-up.
Sec. 2. Minnesota Statutes 1994, section 62A.041, is amended by adding a subdivision to read:
Subd. 4. [INPATIENT CARE.] Every health plan as defined in section 62Q.01, subdivision 3, that provides maternity benefits must, consistent with other coinsurance, copayment, deductible, and related contract terms, provide coverage of a minimum of 48 hours of inpatient care following a vaginal delivery and a minimum of 96 hours of inpatient care following a Caesarean section for a mother and her newborn, if this inpatient care is determined to be medically necessary by the attending health care provider in consultation with the mother. A decision to shorten the duration of inpatient care to less than the minimums provided in this section must be made by the attending physicians after consulting with the mother.
For purposes of this section, attending health care provider includes the attending obstetrician, pediatrician, family physician or other physician, certified nurse midwife, or pediatric nurse practioner attending the mother or her newborn.
The health plan must also provide coverage for postdelivery care to a mother and her newborn if the duration of inpatient care is less than the minimums provided in this section.
Postdelivery care consists of a minimum of one home visit by a registered nurse. Services provided by the registered nurse include, but are not limited to, parent education, assistance and training in breast and bottle feeding, and conducting any necessary and appropriate clinical tests. The home visit must be conducted within a reasonable period of time following the discharge of the mother and her child.
Sec. 3. [EFFECTIVE DATE; APPLICATION.]
Sections 1 and 2 are effective August 1, 1996, and apply to health plans issued or renewed to provide coverage to a Minnesota resident on or after that date."

(c) This section does not apply to antifreeze placed in a
wastewater collection system that includes a publicly or
privately owned treatment works that is permitted by the
agency until December 31, 1996. It does not apply to
antifreeze placed in a privately owned closed loop wastewater
treatment works that is permitted by the agency.
(d) Notwithstanding paragraph (a), motor oil filters and portions of motor oil filters may be processed at a permitted mixed municipal solid waste resource recovery facility that directly burns the waste if:
(1) the facility is subject to an industrial waste management plan that addresses management of motor oil filters and the owner or operator of the facility can demonstrate to the satisfaction of the commissioner that the facility is in compliance with that plan;
(2) the facility recovers ferrous metal after incineration for recycling as part of its operation; and
(3) the motor oil filters are collected separately from mixed municipal solid waste and are not combined with it except for the purpose of incinerating the waste."

Be It Resolved, by the Senate of the State of Minnesota, the House of Representatives concurring:
(a) Except as provided in paragraph (b), in the 1996 regular session, committee reports on bills favorably acted upon by a committee in the house of origin after Friday, February 9, 1996, and committee reports on bills originating in the other house favorably acted upon by a committee after Friday, February 16, 1996, shall be referred in the Senate to the Committee on Rules and Administration, and in the House of Representatives to the Committee on Rules and Legislative Administration for disposition. Referral is not required when a committee after the earlier date and by the later date set by this paragraph acts on a bill that is a companion to a bill that has met the earlier deadline in the other house. This rule does not apply to the Senate Committees on Finance and on Taxes and Tax Laws, and the House Committees on Ways and Means and on Taxes.
