541.073, or 541.076 otherwise prescribes, the following actions shall be commenced within two years:
(1) for libel, slander, assault, battery, false imprisonment, or other tort, resulting in personal injury, and all actions against physicians, surgeons, dentists, occupational therapists, other health care professionals as defined in section 145.61, and veterinarians as defined in chapter 156, hospitals, sanitariums, for malpractice, error, mistake or failure to cure, whether based on contract or tort; provided a counterclaim may be pleaded as a defense to any action for services brought by a physician, surgeon, dentist, occupational therapists, or other health care professional or veterinarian, hospital or sanitarium, after the limitations herein described notwithstanding it is barred by the provisions of this chapter, if it was the property of the party pleading it at the time it became barred and was not barred at the time the claim sued on originated, but no judgment thereof except for costs can be rendered in favor of the party so pleading it;
(2) upon a statute for a penalty or forfeiture, except as provided in sections 541.074 and 541.075;
(3) for damages caused by a dam, other than a dam used for commercial purposes; but as against one holding under the preemption or homestead laws, the limitations shall not begin to run until a patent has been issued for the land so damaged;
(4) against a master for breach of an indenture of apprenticeship; the limitation runs from the expiration of the term of service;
(5) for the recovery of wages or overtime or damages, fees or penalties accruing under any federal or state law respecting the payment of wages or overtime or damages, fees or penalties except, that if the employer fails to submit payroll records by a specified date upon request of the department of labor and industry or if the nonpayment is willful and not the result of mistake or inadvertence, the limitation is three years. (The term "wages" means all remuneration for services or employment, including commissions and bonuses and the cash value of all remuneration in any medium other than cash, where the relationship of master and servant exists and the term "damages" means single, double, or treble damages, accorded by any statutory cause of action whatsoever and whether or not the relationship of master and servant exists);
(6) for damages caused by the establishment of a street or highway grade or a change in the originally established grade;
(7) against the person who applies the pesticide for injury or damage to property resulting from the application, but not the manufacture or sale, of a pesticide.
Sec. 2. [541.076] [LIMITATION ON CERTAIN MEDICAL MALPRACTICE ACTIONS.]
The following actions by a patient or former patient against a health care provider shall be commenced within two years after the patient or former patient discovers or reasonably should have discovered the injury, cause and alleged malpractice, error, mistake, or failure to cure:
(1) an action based on transmission of communicable disease by the health care provider to the
patient or former patient;
(2) an action based on the misdiagnosis of malignant disease; and
(3) an action based on the leaving of a foreign object which has no therapeutic or diagnostic
purpose or effect in the patient or former patient's body.
In no event shall an action under this section be brought more than six years after the date on
which the limitations period would have begun to run under section 541.07, clause (1), had the action been subject to that
provision.
Sec. 3. [EFFECTIVE DATE; APPLICATION.]
Sections 1 and 2 are effective August 1, 1998, and apply to actions commenced on or after that
date."

To demolish the Capitol Square Building in St. Paul, relocate the
department of children, families, and learning (CFL), and the higher
education services office (HESO) and pay for up to four months rent in
a new facility, convert the existing site to temporary parking until a new
state-owned facility can be constructed, and conduct a predesign study
of future facilities for CFL and HESO. This appropriation is from the
general fund.
Subd. 4. Labor Interpretive Center Building 11,200,000
For acquisition and remodeling of the east building of the Science
Museum of Minnesota (SMM) in St. Paul for a labor interpretive center
facility.
Subd. 5. Bald Eagle Center 1,250,000
For a grant to the city of Wabasha for design and construction of the
American bald eagle center.
Subd. 6. Department of Revenue Relocation 5,722,000
To relocate the department of revenue from a leased facility to a new
state-owned facility in the Capitol complex. This appropriation is from
the general fund and includes staging equipment and furnishings
necessary to complete the relocation and to continue critical operations
at the new facility.
Subd. 7. Electrical Utility Infrastructure 5,361,000
To upgrade the primary electrical distribution system in the
Capitol complex and to upgrade the mechanical infrastructure in the
east Capitol area. This appropriation is from the general fund.
Subd. 8. Agency Relocation 10,550,000
$648,000 is from the trunk highway fund for relocation of a portion of
the department of transportation offices during the final phase of
renovation to the department of transportation building in the Capitol
complex.
$9,902,000 is from the general fund for relocation of the emergency
management and capitol security divisions of the department of public
safety, department of administration plant management and
environmental management divisions, department of health operations
in the Central Medical building in St. Paul, department of commerce
operations at 133 East Seventh street in St. Paul, department of labor
and industry in St. Cloud, and department of human services operations
at various locations.
Subd. 9. Capitol Security and Plant Management Facility Predesign 45,000
To conduct a predesign of a new facility for the department of public
safety's capitol security division and the department of administration's
plant management division.
Subd. 10. Transportation Building Renovation 15,775,000
To complete renovation and life safety improvements to the
transportation building in the Capitol complex. This appropriation is
from the trunk highway fund and is the final state appropriation for this
project.
Subd. 11. Real Property Acquisition 3,300,000
This appropriation is from the general fund for acquisition of land and
purchase options in order to hold properties that meet state development
needs.
Subd. 12. Bureau of Criminal Apprehension Facility Design 2,815,000
For design of a new bureau of criminal apprehension (BCA) building.
Subd. 13. Dahl House Relocation 100,000
This appropriation is from the general fund to relocate the Dahl house
to a more suitable site outside of the Capitol complex.
Sec. 3. AMATEUR SPORTS COMMISSION
Subdivision 1. To the amateur sports commission for the purposes
specified in this section 14,225,000
Subd. 2. National Sports Center 4,800,000
$2,000,000 from the general fund is for purchase and development of
land for the National Children's Golf Course in Blaine. On weekends
and during school vacations, a person age 18 or over may not use the
golf course constructed with these funds unless the person is
accompanied by a youth under age 18. A youth may not accompany
more than one person over age 18, except for family members. The
restrictions in this paragraph do not apply if there is space available
when a person arrives at the course without a reservation.
$1,000,000 from the general fund is for grants for development or
improvement of facilities or programs to improve access to golf for
economically disadvantaged youth.
$1,800,000 from the general fund is for the purchase and development
of land to expand the National Sports Center in Blaine, and
development of athletic fields.
Subd. 3. Giants Ridge Facility 690,000
For a grant to the Iron Range resources and rehabilitation board to
enhance the Giants Ridge cross-country ski event facility. This
appropriation is from the general fund.
Subd. 4. Minneapolis Urban Sports Center 600,000
For a grant to special school district No. 1, Minneapolis, to complete
funding for an urban sports facility, to be owned by the district. This
appropriation is in addition to the project appropriation of $3,400,000
in Laws 1996, chapter 463, section 14, subdivision 5, paragraph (a),
and subject to the conditions contained therein.
Subd. 5. Tennis Facility 3,400,000
For a grant to the city of St. Paul to design, construct, furnish, and equip
a tennis center to offer indoor tennis facilities, subject to the
requirements of Minnesota Statutes, section 16A.695.
Subd. 6. Mt. Itasca Ski Area 135,000
For a grant to the Iron Range resources and rehabilitation board to
expand the facilities at Mt. Itasca ski area. This appropriation is from
the general fund.
Subd. 7. Ice Arena Grants 3,600,000
$2,500,000 is for grants for new ice arenas under Minnesota Statutes,
section 240A.09.
$1,100,000 is for ice arena renovation grants under Minnesota Statutes,
section 240A.09.
Subd. 8. Women's Hockey Programs 1,000,000
From the general fund for a grant to the University of Minnesota
at Duluth and grants to the Minnesota state colleges and universities
board of regents for costs related to startup and operations of women's
hockey programs.
Sec. 4. CAPITOL AREA ARCHITECTURAL AND PLANNING BOARD
Subdivision 1. To the commissioner of administration for the purposes

To stabilize the Capitol building's structure and provide related facility
improvements.
Subd. 3. Capitol Building Accessibility 1,344,000
To design and construct exterior doors on the Capitol's ground, first,

The commissioner of administration and the capitol area architectural
and planning board shall study and report to the legislature by
January 15, 1999, on possible improvements of the stairs from the
tunnel to the Capitol, so as to encourage greater use of stairs and less
use of elevators.
Subd. 4. Aurora Street Rehabilitation 400,000
To redesign and improve Aurora street in front of the Capitol; with
related parking and security improvements.
Subd. 5. Capitol Grounds 442,000
For repair of: the pool and sculpture at the veterans service building;
the plaza and wall of the Floyd B. Olson Memorial; and the plaza at the
Lindbergh Memorial.
Subd. 6. Capitol 700,000
For exterior directional, informational, parking, and building signage in
the Capitol complex. Up to $320,000 of this amount may be used for
predesign of interior restoration projects in the Capitol building.
Sec. 5. MILITARY AFFAIRS

products were dispensed at the location owned by the retailer, the board shall reimburse the applicant for 90 percent of the
applicant's total reimbursable cost for tank removal projects started after January 1,
(c) Notwithstanding subdivision 1, paragraph (b), clause (1), for eligible applicants who are small gasoline
retailers that have dispensed less than 250,000 gallons of motor fuel during the most recent calendar year that petroleum
products were dispensed at the location owned by the retailer, provided that the tank involved is a regulated underground
storage tank, the board shall reimburse the applicant for 95 percent of the following costs:
(1) tank removal costs described in paragraph (b); and
(2) petroleum contamination cleanup as provided under subdivision 1 incurred during or after the tank removal
project.
(d) An applicant who owns only one location in this or any other state where motor fuel was dispensed to the public
into motor vehicles, watercraft, or aircraft but who did not dispense motor fuel at that location may qualify as a small gasoline
retailer if:
(1) the previous tank owner or operator at the location was a small gasoline retailer that dispensed less than 500,000
gallons of motor fuel during the most recent calendar year that petroleum products were dispensed at the location; and
(2) the applicant acquired legal or equitable title to the property after January 1, 1996.
(e) This subdivision expires January 1, 2000.
Sec. 2. Minnesota Statutes 1996, section 115C.09, is amended by adding a subdivision to read:
Subd. 3g. [REIMBURSEMENTS; SMALL BUSINESS OWNERS.] (a) As used in this subdivision, "small
business owner" means a person:
(1) who has no more than $50,000 per year in sales;
(2) who owns no more than one location where motor fuel was previously dispensed to the public into motor
vehicles;
(3) who did not dispense motor fuel at that location; and
(4) whose tanks were never registered with the state.
(b) Notwithstanding subdivision 1, paragraph (b), clause (1), the board shall reimburse an eligible applicant who is
a small business owner for 90 percent of the applicant's total reimbursable cost for tank removal projects started after
January 1, 1998, including, but not limited to, tank removal, closure in place, backfill, resurfacing, and utility service
restoration costs, regardless of whether a release has occurred at the site, and provided that the person does not intend to
replace the tanks.
Sec. 3. [EFFECTIVE DATE.]
Section 1 is effective the day following final enactment. "

introduced: House Resolution No. 10, A house resolution commemorating the life
and work of Representative Ken Otremba.
McCollum moved that the rules be so far suspended that
House Resolution No. 10 be now considered and be placed upon its adoption. The

Representative Ken Otremba.
Whereas, Ken Otremba grew up
in Buckman, Minnesota; and
Whereas, he served for six
years in the Navy as a radar technician, including two tours of duty in Vietnam;
and
Whereas, a dairy farmer for 20
years, he was also a Reynolds Township supervisor and a Todd County
commissioner; and
Whereas, first elected to the
legislature in 1994, he ran for reelection in 1996 after learning that he had
cancer of the liver; and
Whereas, in spite of his
illness, he served all through the 1997 regular session and two special
sessions, never missing a vote; and
Whereas, he was dedicated to
solving the problems of the people of his district, and his compassion and
sincerity in serving them will be long remembered; and
Whereas, Ken Otremba passed
away on September 4, 1997, at his home near Long Prairie, Minnesota; Now, Therefore,
Be It Resolved by the House of
Representatives of the State of Minnesota that it holds in honor the memory of
Representative Ken Otremba and his remarkable service to the people of Minnesota
even in the face of adversity. It extends its condolences to his wife,
Representative Mary Ellen Otremba, to his children, his mother, his brothers and
sisters, and to all the people of District 11B who knew him.
Be It Further Resolved that
the Chief Clerk of the House of Representatives is directed to prepare an
enrolled copy of this resolution, to be authenticated by his signature and that
of the Speaker, and transmit it to the family of Ken Otremba.
McCollum moved that House Resolution No. 10 be now
adopted. The motion prevailed and House Resolution No. 10 was adopted.
