I have vetoed and am returning H. F. No. 2598, Chapter No. 391, a bill requiring school pledge of allegiance recitation.
I am vetoing this bill because being able to express our love of our country is an important freedom, and it's not one that I'm willing to trust to the government. As a veteran, I served my country to protect freedom, not just a symbol. A person gets from a symbol the meaning he puts into it, and what is one man's comfort and inspiration is another's jest and scorn.
Patriotism comes from the heart. If people really love their country, they shouldn't have to be prompted by government to express their feelings. If our own initiative isn't enough to express pride in our country, then blame lies with us and not the government.
According to West Virginia Board of Education v. Barnette, the action of the local authorities in compelling the flag salute and pledge transcends constitutional limitations on their power, and invades the sphere of intellect and spirit which it is the purpose of the First Amendment to our Constitution to reserve from all official control. Thus, the sole conflict is between authority and the rights of individuals.
For these reasons, I vetoed this bill.

I have signed H. F. No. 3618, Chapter No. 393, a bill related to capital improvements, with the exception of the line item vetoes listed on the attachment to this letter.
When I presented my 2002 capital budget recommendations in January, they focused on projects of statewide and regional significance. In addition, all of the debt service costs associated with my capital budget recommendations were provided for F.Y. 2002-2003 and F.Y. 2004-2005 in my operating budget recommendations.
The Legislature has chosen to pass and present a significantly-expanded bonding bill that substitutes projects of local significance for those with statewide and regional significance such as the Northstar commuter rail line. In addition, the Legislature did not adopt a fully-funded budget plan that would pay for the added debt service costs in F.Y. 2004-2005.
As a result, I cannot in good conscience approve all the projects in the 2002 bonding bill. While many of these projects may be worthy of state investment, their funding will need to be delayed. I will not add approximately $73 million of additional debt service costs in the next biennium and needlessly increase the size of the projected deficit. We need to show restraint by not aggravating what is already likely to be a huge budget problem for the next Legislature.
While I have not line item vetoed Nicholson Hall, the flood hazard mitigation grants, and local bridges, I do not intend to release all of the funding for each of these projects. I will release $10 million dollars for Nicholson Hall, $15 million dollars for flood hazard mitigation grants, and $30 million dollars for local bridges. I further recommend that the next Governor, be it myself or another person, only release the balance of the funding for these projects if the Legislature produces a balanced budget. I choose this course of action because each of the projects has merit but cannot be supported at the recommended level of funding given our budget situation.
