(a) An assignment, satisfaction, release, or power of
attorney to foreclose is entitled to be recorded in the office of the county
recorder or filed with the registrar of titles and is sufficient to assign,
satisfy, release, or authorize the foreclosure of a mortgage, as the case may
be, if:
(1) a mortgage is granted to a mortgagee as nominee or agent
for a third party identified in the mortgage, and the third party's successors
and assigns;
(2) a subsequent assignment, satisfaction, release of the
mortgage, or power of attorney to foreclose the mortgage, is executed by the
mortgagee or the third party, its successors or assigns; and
(3) the assignment, satisfaction, release, or power of
attorney to foreclose is in recordable form.
The county recorder and
registrar of titles shall rely upon such assignment, satisfaction, release, or
power of attorney to foreclose to assign, satisfy, release, or foreclose
said mortgage.
(b) This section applies to any mortgage, assignment,
satisfaction, release, or power of attorney to foreclose executed, recorded, or
filed before, on, or after the effective date of this section."

BY THE GOVERNOR
Governor Tim Pawlenty was presented by the President of the
Joint Convention, the Honorable Steve Sviggum, and the Governor delivered his
"State of the State Address" to the members of the Joint Convention
and their guests.
Following the address, Senator Johnson, D. E., moved that the
Joint Convention arise. The motion prevailed
and the President declared the Joint Convention adjourned.

HOUSE RESOLUTION NO. 14
A House resolution honoring the memory of Chuck Brown.
Whereas, Chuck Brown, a former legislator from Appleton
who served in the state House of Representatives from 1984 to 1996 passed away
Thursday, August 14, 2003; and
Whereas, as a Minnesota legislator he worked tirelessly
to help ease constituents' financial pain during hard times in the 1980s; and
Whereas, during his service as a state representative,
Chuck fought against the legislation of BST and worked diligently on numerous
key pieces of farm legislation; and
Whereas, Chuck was instrumental in developing a program
of mediation between farmers and lenders during the economic downturn of the
1980s; and
Whereas, Chuck Brown had an extraordinary ability to
work with both republicans and democrats to better the lives of many people in
the state of Minnesota; and
Whereas, Chuck Brown could always make you feel that the
conversation you were having with him was the most important conversation of
the day; and
Whereas, after distinguished service in the Minnesota
House of Representatives, Chuck went on to lobby to continue his work on behalf
of all Minnesotans; and
Whereas, Chuck always had a smiling face, a witty word,
and a joke for everyone; and
Whereas, Chuck was known to treat staff regardless of party affiliation with the
utmost respect; Now, Therefore,
Be It Resolved by the House of Representatives of the
State of Minnesota that it remembers Chuck Brown for his dedication to rural
Minnesota and sends its condolences to his wife Becky and four daughters
Bridget, Kelsy, Megan, and Katie.
Be It Further Resolved that the Chief Clerk of the House
of Representatives is directed to prepare an enrolled copy of this resolution,
to be authenticated by his signature and that of the Speaker, and transmit it
to the family of Chuck Brown.
Peterson and Westrom moved that House Resolution No. 14 be now
adopted. The motion prevailed and House
Resolution No. 14 was adopted.
IN MEMORIAM
The members of the House paused for a moment of silence in
memory of former Representative Chuck Brown, District 13A, Appleton, Minnesota,
who passed away on Thursday, August 14, 2003.
In honor and memory of former Representative Chuck Brown, Erin
Tosel, a friend of the family sang "God Bless America."
Swenson, Harder, Juhnke, Hausman, Magnus, Urdahl and Lindgren
introduced:
House Resolution No. 15, A House resolution honoring the life
and career of Dr. Benjamin S. Pomeroy.
The resolution was referred to the Committee on Agriculture
