Dear Speaker Sviggum:
I have vetoed and am returning to you H. F. No. 1861, Chapter
No. 168, a bill that expands the limited liability for certain private land
owners who grant written or oral permission for individuals to use their
property for certain recreational purposes.
The bill expands recreational purposes to include rock climbing and cave
exploration.
Under current law, an owner who gives written or oral
permission to use land for defined "recreational purposes" without
charge has essentially the same duty to users as would apply to
trespassers. While I agree with this
goal, I am concerned about the unintended consequences of this legislation. The recent deaths of the teenagers in St.
Paul illustrate the potential extreme danger of these recreational activities.
I am concerned that this legislation would encourage land
owners to become less vigilant about the posting of dangerous property signs
and would cease to limit potentially dangerous activities on private land.
Although the dangers may not be as risky for persons who have
significant knowledge, such as the members of the Minnesota Speleological
Survey organization (the group promoting this bill), given the recent tragedy,
we need to know more about the inherent dangers of this activity before the
state takes an affirmative action to limit liability for the purpose of
encouraging recreational activity.
At this time, I believe the limited liability should not be
expanded for rock climbing and cave exploration.

It is my honor to inform you that I have
received, approved, signed, and deposited in the Office of the Secretary of
State the following House Files:
H. F. No. 2363,
H. F. No. 606, relating to health;
modifying prior authorization requirements for health care services;
establishing requirements for provider contracting; modifying provisions for payment
of claims.
H. F. No. 2166, relating to the military;
reserving a military family's position under the child care assistance fund;
prohibiting potential employers from inquiring about National Guard or reserve
status; transferring responsibility for the veterans training program and
general responsibility for veterans educational benefits to the commissioner of
veterans affairs; requiring payment of a salary differential to school district
employees who have reported to active military duty; requiring the commissioner

areas; establishing Greenleaf Lake State Park; appropriating money.
H. F. No. 2762, relating to health;
regulating coverages; regulating the Minnesota Comprehensive Health
Association; providing for the composition of the board; authorizing an
enrollee incentive for participation in a disease management program; phasing
out Medicare-extended basic supplement plans; providing for high deductible
plans; authorizing purchasing alliances to include seasonal employees;
regulating trade practices; regulating certain health occupations and
professions; requiring certain pharmacy benefit disclosures; providing an
effective date for a certain hospital construction moratorium exemption;
requiring a study.
H. F. No. 2378, relating to local
government; adding to the list of unpaid special charges for which a city may
collect a service charge as a special assessment; providing for the expiration
of one of the additions; making a conforming change; providing for the
dedication of certain fees for public use of certain state-owned facilities at
Giants Ridge; appropriating money.
H. F. No. 2175, relating to health;
modifying requirements for various public health occupations; prescribing
authority of speech-language pathology assistants; providing for renewal of
certain licenses by members of the military; modifying requirements for
physician assistants, acupuncture practitioners, nurses, licensed professional
counselors, alcohol and drug counselors, dentists, dental hygienists, dental
assistants, and podiatrists; modifying provisions for designating essential
community providers; modifying certain immunization provisions; providing for
performance reviews of certain executive directors; requiring a study;
extending the Minnesota Emergency Health Powers Act; appropriating money.

finance; authorizing principles, criteria, and procedures for consolidating and
eliminating certain funds and accounts; requiring reports; making technical and
clarifying changes to provisions related to the budget process.

Dear Speaker Sviggum:
It is my honor to inform you that I have received, signed and
deposited in the Office of the Secretary of State, H. F. No. 2255,
Chapter No. 271. I have exercised
line item vetoes on the items of appropriation contained on page 2, Section 2, Subdivision 1,
lines 17‑22 and on page 2, Section 2, Subdivision 1, lines 23-32 of
H. F. No. 2255, Chapter No. 271.
Section 2, Subdivision 1, lines 17-22 appropriated $27,000 from
the general fund to provide for full and final settlement of Linda and Judy
Bode's claims against the state.
Section 2, Subdivision 1, lines 23-32 is dependant upon the
appropriation of money.
I do not believe this appropriation is in the best interests of
the State of Minnesota. The language
making the appropriation provides that the appropriation is for the purpose of
obtaining "full and final settlement" of the Bode's claims against
the state. However, the additional
language in Section 2, Subdivision 1 makes it clear that the payment of money
envisioned by the appropriation requires the state to initiate an
administrative hearing to once again reconsider the status of land currently
designated as a public wetland.
The legal claims regarding the designation of the Bode's land
as a public wetland are final court orders.
Allowing one claimant a special privilege to circumvent the results of
final court decisions sets a dangerous precedent. More legal proceedings on this issue and more attempts to
declassify this land as a public wetland is not a "full and final
settlement" which is the stated purpose of the appropriation. Moreover, the legislature failed to
appropriate any funds to cover the costs of the administrative hearing.
The Department of Natural Resources remains committed to work
with the Bodes on acquiring an easement or other agreeable restoration
strategies.
