CERTAIN CONTRACTS PROHIBITED.
Subdivision 1. Discrimination
by vendor. (a) A state
agency, including the Minnesota State Colleges and Universities, and entities
in the legislative branch may not enter into a contract with a vendor that
engages in discrimination against Israel, or against persons or entities doing
business in Israel, when making decisions related to the operation of the
vendor's business. A contract must
include terms that require the vendor to certify compliance with this section,
and which permit immediate termination of the contract, without penalty, if the
state agency or legislative entity determines that the vendor's business
practices do not comply with this section after the contract is entered.
(b) For purposes of this section,
"discrimination" includes but is not limited to engaging in refusals
to deal, terminating business activities, or other actions that are intended to
limit commercial relations with Israel, or persons or entities doing business
in Israel, when such actions are taken:
(1) in compliance with or in adherence
to calls for discrimination against Israel or a boycott of Israel, other than
those boycotts to which United States Code Appendix, title 50, section 2407(c),
applies; or
(2) in a manner that in any way
discriminates on the basis of nationality or national origin and is not based
on a valid business reason.
Subd. 2. Exemption;
commissioner may waive. (a)
This section does not apply to contracts with a value of less than $1,000.
(b)
The commissioner may waive application of this section on a contract if the
commissioner determines that compliance is not practicable or in the best
interests of the state.
EFFECTIVE DATE. This section is effective July 1, 2017, and
applies to contracts entered into on or after that date."

Subd. 2. Reinstatement. Except as provided in this section, upon
the completion of the last legislative day in each calendar year, or, in the
case of an elected city or, county, or tribal council
official, on the completion of the final day of the term to which the official
was elected, the officer or employee shall be reinstated in the public position
held at the time of entry into the legislature or taking city or,
county, or tribal council office, or be placed in a public position of
like seniority, status, and pay if it is available at the same salary which
would have been received if the leave had not been taken, upon the following
conditions:
(1) that the position has not been abolished or that its term, if limited, has not expired;
(2) that the legislator makes a written
application for reinstatement to the appointing authority within 30 days after
the last legislative day in a calendar year or, in the case of an elected city or,
county, or tribal council official, within 30 days after the expiration
of the elected term; and
(3) that the request for reinstatement is made not later than ten years after the granting of the leave.
Upon reinstatement, the officer or employee shall have the
same rights with respect to accrued and future seniority status, efficiency rating,
vacation, insurance benefits, sick leave, and other benefits as if actually
employed during the time of the leave. No
public employer is required to compensate a reinstated employee or officer for
time spent by that employee or officer away from work for the employer and on
the business of the state legislature during the period between the first and
last legislative day in each calendar year or on the business of an elected
city or, county, or tribal council office. No officer or employee reinstated shall be
removed or discharged within one year after reinstatement except for cause and
after notice and hearing, but this does not extend a term of service limited by
law.
Sec. 3. Minnesota Statutes 2016, section 3.088, subdivision 3, is amended to read:
Subd. 3. Pension
and retirement rights. A public
officer or employee who receives leave of absence under this section or is
elected as a state constitutional officer and has rights in a state, municipal,
or other public pension, retirement, or relief system shall retain all the
rights accrued up to the time of taking leave.
Time spent by the employee as a member of the legislature or as an
elected city or, county, or tribal council official or
state constitutional officer shall be calculated in the same manner as if the
employee had spent that time in the service of the public employer for the
purpose of determining vesting of the employee's rights in the employer's
pension, retirement, or relief system. Under
no circumstances shall two governmental units pay the employee's share of
pension contributions when the employee is on leave of absence to serve in the
legislature or as an elected city or, county, or tribal
council official."

transmission cooperative that serves a cooperative electric association
operating in Minnesota shall collectively submit a report to the chairs and
ranking minority members of the senate and house committees with jurisdiction
over energy policy that compares the local economic impact of purchasing and
generating energy from wind and solar generators with the local economic impact
of purchasing and generating energy from fossil fuels. The report must include quantitative and
qualitative information on, at a minimum, the following topics:
(1) the proportion of a retail
customer's dollar spent for electricity that remains in Minnesota's economy and
the proportion that is exported outside the state when that electricity is
purchased from and generated by solar and wind generators and is purchased from
and generated by fossil fuels; and
(2) the employment impacts, including the number of direct, indirect, and induced jobs in Minnesota associated with an equivalent retail expenditure on electricity generated by wind and solar generators and by fossil fuel generators."

account, each year since 1999 for each dry cask containing spent fuel that is
stored at an independent spent-fuel storage facility at Prairie Island or
Monticello. During the time when state
law required the public utility to transfer a specific amount of funds to the
account for all the casks stored, the per-cask allocation shall be calculated
by dividing the total amount transferred by the number of casks stored that
year.
(b)
When the commissioner determines that the cumulative transfers calculated under
paragraph (a) for a specific cask reach $10,000,000, the commissioner shall
notify the public utility that no additional transfers to the account for that
cask shall be made.
(c) This subdivision does not affect
any provisions of subdivision 1, paragraph (c) or (d), with respect to
transfers to the account made after a plant has ceased operation.
EFFECTIVE DATE. This section is effective the day following final enactment."
