The commissioner shall call and attend meetings and conferences dealing with the subject of noxious weeds. The commissioner shall maintain on the department's Web site noxious weed management information including but not limited to the roles and responsibilities of citizens and government entities under sections 18.76 to 18.91 and specific guidance as to whom a person should contact to report a noxious weed issue.
(b) The commissioner shall post notice on the commissioner's Web site and in appropriate agricultural media when a weed on the eradicate list is confirmed for the first time in a county."

PALLIATIVE CARE ADVISORY COUNCIL.
Subdivision 1. Establishment. The Palliative Care Advisory Council
is established to advise and assist the commissioner of health regarding
improving the quality and delivery of patient-centered and family-focused
palliative care.
Subd. 2. Membership. (a) The council shall consist of 18
public members and four members of the legislature.
(b) The commissioner shall appoint 18
public members, including at least the following:
(1) two physicians, of which one is
certified by the American Board of Hospice and Palliative Medicine;
(2) two registered nurses or advanced
practice registered nurses, of which one is certified by the National Board for
Certification of Hospice and Palliative Nurses;
(3)
one care coordinator experienced in working with people with serious or chronic
illness and their families;
(4) one spiritual counselor experienced
in working with people with serious or chronic illness and their families;
(5) three licensed health
professionals, such as complementary and alternative health care practitioners,
dietitians or nutritionists, pharmacists, or physical therapists, who are
neither physicians nor nurses, but who have experience as members of a
palliative care interdisciplinary team working with people with serious or
chronic illness and their families;
(6) one licensed social worker
experienced in working with people with serious or chronic illness and their
families;
(7) four patients or personal
caregivers experienced with serious or chronic illness;
(8) one representative of a health plan
company; and
(9) one physician assistant that is a
member of the American Academy of Hospice and Palliative Medicine.
(c) The Subcommittee on Committees of
the Committee on Rules and Administration shall appoint one member of the
senate, the minority leader in the senate shall appoint one member of the
senate, the speaker of the house shall appoint one member of the house of
representatives, and the minority leader in the house of representatives shall
appoint one member of the house of representatives.
(d) Council membership must include,
where possible, representation that is racially, culturally, linguistically,
geographically, and economically diverse.
(e) The council must include at least
six members who reside outside Anoka, Carver, Chisago, Dakota, Hennepin,
Isanti, Mille Lacs, Ramsey, Scott, Sherburne, Sibley, Stearns, Washington, or
Wright Counties.
(f) Council membership must include
health professionals who have palliative care work experience or expertise in
palliative care delivery models in a variety of inpatient, outpatient, and
community settings, including acute care, long-term care, or hospice, with a
variety of populations, including pediatric, youth, and adult patients.
(g) To the extent possible, council
membership must include persons who have experience in palliative care
research, palliative care instruction in a medical or nursing school setting,
palliative care services for veterans as a provider or recipient, or pediatric
care.
Subd. 3. Term. Members of the council shall serve for
a term of three years and may be reappointed.
Members shall serve until their successors have been appointed.
Subd. 4. Administration. The commissioner or the commissioner's
designee shall provide meeting space and administrative services for the
council.
Subd. 5. Initial
appointments and first meeting. The
appointing authorities shall appoint the first members of the council by July
1, 2017. The commissioner shall convene
the first meeting by September 15, 2017, and the commissioner or the
commissioner's designee shall act as chair until the council elects a chair at
its first meeting.
Subd. 6. Chairs. At the council's first meeting, and
biannually thereafter, the members shall elect a chair and a vice-chair whose
duties shall be established by the council.
Subd. 7. Meeting. The council chair shall fix a time and
place for regular meetings of the council, which shall meet at least twice
yearly.
Subd. 8. No
compensation. Public members
of the council serve without compensation, except for reimbursement from the
commissioner for allowed actual and necessary expenses incurred in the
performance of the public member's council duties.
Subd. 9. Duties. (a) The council shall consult with and
advise the commissioner on matters related to the establishment, maintenance,
operation, and outcomes evaluation of palliative care initiatives in the state.
(b) By February 15 of each year, the
council shall prepare and submit to the chairs and ranking minority members of
the committees of the senate and the house of representatives with primary
jurisdiction over health care a report containing a description of:
(1) the advisory committee's assessment
of the availability of palliative care in the state;
(2) the advisory committee's analysis
of barriers to greater access to palliative care; and
(3) recommendations for legislative
action.
(c) The Department of Health shall
publish the report each year on the department's Web site.
EFFECTIVE DATE. This section is effective the day following final enactment."

Subd. 3. Council recommendations. (a) The council shall make recommendations to the legislature on appropriations of money from the outdoor heritage fund that are consistent with the Constitution and state law and that will achieve the outcomes of existing natural resource plans, including, but not limited to, the Minnesota Statewide Conservation and Preservation Plan, that directly relate to the restoration, protection, and enhancement of wetlands, prairies, forests, and habitat for fish, game, and wildlife, and that prevent forest fragmentation, encourage forest consolidation, and expand restored native prairie. In making recommendations, the council shall consider a range of options that would best restore, protect, and enhance wetlands, prairies, forests, and habitat for fish, game, and wildlife. The council recommendations each year on appropriation of money from the outdoor heritage fund must include amounts adequate to make the required transfers to the outdoor heritage trust fund payment account according to subdivision 1b. The council's recommendations shall be submitted no later than January 15 each year. The council shall present its recommendations to the senate and house of representatives committees with jurisdiction over the environment and natural resources budget by February 15 in odd-numbered years, and within the first four weeks of the legislative session in even-numbered years. The council's budget recommendations to the legislature shall be separate from the Department of Natural Resource's budget recommendations.
(b) To encourage and support local conservation efforts, the council shall establish a conservation partners program. Local, regional, state, or national organizations may apply for matching grants for restoration, protection, and enhancement of wetlands, prairies, forests, and habitat for fish, game, and wildlife, prevention of forest fragmentation, encouragement of forest consolidation, and expansion of restored native prairie.
(c) The council may work with the Clean Water Council to identify projects that are consistent with both the purpose of the outdoor heritage fund and the purpose of the clean water fund.
(d) The council may make recommendations to the Legislative-Citizen Commission on Minnesota Resources on scientific research that will assist in restoring, protecting, and enhancing wetlands, prairies, forests, and habitat for fish, game, and wildlife, preventing forest fragmentation, encouraging forest consolidation, and expanding restored native prairie.
(e) Recommendations of the council, including approval of recommendations for the outdoor heritage fund, require an affirmative vote of at least nine members of the council.
(f) The council may work with the Clean Water Council, the Legislative-Citizen Commission on Minnesota Resources, the Board of Water and Soil Resources, soil and water conservation districts, and experts from Minnesota State Colleges and Universities and the University of Minnesota in developing the council's recommendations.
(g) The council shall develop and implement a process that ensures that citizens and potential recipients of funds are included throughout the process, including the development and finalization of the council's recommendations. The process must include a fair, equitable, and thorough process for reviewing requests for funding and a clear and easily understood process for ranking projects.
(h) The council shall use the regions of the state based upon the ecological sections and subsections developed by the Department of Natural Resources and establish objectives for each region and subregion to achieve the purposes of the fund outlined in the state constitution.
(i) The council shall develop and submit to the Legislative Coordinating Commission plans for the first ten years of funding, and a framework for 25 years of funding, consistent with statutory and constitutional requirements. The council may use existing plans from other legislative, state, and federal sources, as applicable.
EFFECTIVE DATE. This section is effective July 1, 2017, and applies to lands acquired with money appropriated on or after that date."

"Sec. 12. Minnesota Statutes 2016, section 116P.08, subdivision 1, is amended to read:
Subdivision 1. Expenditures. Money in the trust fund may be spent only for:
(1) the reinvest in Minnesota program as provided in section 84.95, subdivision 2;
(2) research that contributes to increasing the effectiveness of protecting or managing the state's environment or natural resources;
(3) collection and analysis of information that assists in developing the state's environmental and natural resources policies;
(4) enhancement of public education, awareness, and understanding necessary for the protection, conservation, restoration, and enhancement of air, land, water, forests, fish, wildlife, and other natural resources;
(5) capital projects for the preservation and protection of unique natural resources;
(6) activities that preserve or enhance fish, wildlife, land, air, water, and other natural resources that otherwise may be substantially impaired or destroyed in any area of the state;
(7) administrative and investment expenses
incurred by the State Board of Investment in investing deposits to the trust
fund; and
(8) administrative expenses subject to the
limits in section 116P.09.; and
(9)
payments to the environment and natural resources trust fund payment account as
required in section 116P.045.
EFFECTIVE
DATE. This section is
effective July 1, 2017, and applies to lands acquired with money appropriated
on or after that date.
Sec. 13. Minnesota Statutes 2016, section 116P.08, subdivision 4, is amended to read:
Subd. 4. Legislative recommendations. (a) Funding may be provided only for those projects that meet the categories established in subdivision 1.
(b) The commission must recommend an annual or biennial legislative bill to make appropriations from the trust fund for the purposes provided in subdivision 1. The recommendations must be submitted to the governor for inclusion in the biennial budget and supplemental budget submitted to the legislature.
(c) The commission may recommend regional block grants for a portion of trust fund expenditures to partner with existing regional organizations that have strong citizen involvement, to address unique local needs and capacity, and to leverage all available funding sources for projects.
(d) The commission may recommend the establishment of an emerging issues account in its legislative bill for funding emerging issues, which come up unexpectedly, but which still adhere to the commission's strategic plan, to be approved by the governor after initiation and recommendation by the commission.
(e) The council must recommend an
appropriation of money from the environment and natural resources trust fund
adequate to make the required transfers to the environment and natural
resources trust fund payment account according to section 116P.045.
(f) Money in the trust fund may not be spent except under an appropriation by law.
EFFECTIVE DATE. This section is effective July 1, 2017, and applies to lands acquired with money appropriated on or after that date."

"Section 1. RULEMAKING.
The commissioner of labor and industry
shall amend Minnesota Rules, part 1309.0313, IRC sections R313.1 to R313.3, to
establish that one- and two-family dwellings and two-unit townhouses are not
required to have installed automatic fire
sprinkler systems. The commissioner may
use the exempt provisions of Minnesota Statutes, section 14.386, except
that paragraph (b) shall not apply.
EFFECTIVE
DATE. This section is
effective the day following final enactment.

the effective date of section 1 and final adoption of a rule that amends
Minnesota Rules, part 1309.0313, to prohibit mandatory installation of
automatic fire sprinkler systems for two-unit townhouses.
EFFECTIVE DATE. This section is effective the day following final enactment."

(1) when issuing, modifying, or renewing national pollutant discharge elimination system (NPDES) or state disposal system (SDS) permits, the agency shall endeavor to protect wild rice, and in doing so shall be limited by the following conditions:
(i) the agency shall not require permittees to expend money for design or implementation of sulfate treatment technologies or other forms of sulfate mitigation; and
(ii) the agency may require sulfate minimization plans in permits; and
(2) the agency shall not list waters containing natural beds of wild rice as impaired for sulfate under section 303(d) of the federal Clean Water Act, United States Code, title 33, section 1313, until the rulemaking described in this paragraph takes effect.
(b) Upon the rule described in paragraph (a) taking effect, the agency may reopen permits issued or reissued after the effective date of this section as needed to include numeric permit limits based on the wild rice water quality standard.
(c) The commissioner shall complete the
rulemaking described in paragraph (a) by January 15, 2018 2019."

(1) that the project for which the
grant is made has been reviewed as provided in subdivision 4;
(2) that the project conforms to

Sec. 2. Minnesota Statutes 2016, section 174.50, subdivision 6b, is amended to read:
Subd. 6b. Bridge costs in smaller cities. (a) The commissioner may make grants from the state transportation fund to a home rule or statutory city with a population of 5,000 or less for design, engineering, and construction of bridges on city streets.
(b)
Grants under this subdivision are subject to the procedures and criteria
established under subdivisions 5, 6, and 7.
(c) (b) Grants may be used
for:
(1) 100 percent of the design and engineering costs that are in excess of $10,000;
(2) 100 percent of the bridge approach work costs that are in excess of $10,000; and
(3) 100 percent of the bridge construction work costs.
Sec. 3. Minnesota Statutes 2016, section 174.50, subdivision 6c, is amended to read:
Subd. 6c. Fracture-critical
bridges. (a) The commissioner
may make a grant to any political subdivision for replacement or rehabilitation
of a fracture-critical bridge. To be
eligible for a grant under this subdivision, the project must produce a bridge
structure:
(1) that is no longer classified as fracture critical, by having alternate load paths; and
(2) whose failure of a main component will not result in the collapse of the bridge.
(b)
A grant under this subdivision is subject to the procedures and criteria
established under subdivisions 5 and 6."
