Subdivision 1. Subsidy restrictions. (a) Beginning February 3, 2014, the maximum rate paid for child care assistance in any county or county price cluster under the child care fund shall be the greater of the 25th percentile of the 2011 child care provider rate survey or the maximum rate effective November 28, 2011. For a child care provider located within the boundaries of a city located in two or more counties, the maximum rate paid for child care assistance shall be equal to the maximum rate paid in the county with the highest maximum reimbursement rates or the provider's charge, whichever is less. The commissioner may: (1) assign a county with no reported provider prices to a similar price cluster; and (2) consider county level access when determining final price clusters.
(b) A rate which includes a special needs rate paid under subdivision 3 may be in excess of the maximum rate allowed under this subdivision.
(c) The department shall monitor the effect of this paragraph on provider rates. The county shall pay the provider's full charges for every child in care up to the maximum established. The commissioner shall determine the maximum rate for each type of care on an hourly, full-day, and weekly basis, including special needs and disability care. The maximum payment to a provider for one day of care must not exceed the daily rate. The maximum payment to a provider for one week of care must not exceed the weekly rate.
(d) Child care providers receiving reimbursement under this chapter must not be paid activity fees or an additional amount above the maximum rates for care provided during nonstandard hours for families receiving assistance.
(e) When the provider charge is greater than the maximum provider rate allowed, the parent is responsible for payment of the difference in the rates in addition to any family co-payment fee.
(f) All maximum provider rates changes shall be implemented on the Monday following the effective date of the maximum provider rate.
(g) Notwithstanding Minnesota Rules, part 3400.0130, subpart 7, maximum registration fees in effect on January 1, 2013, shall remain in effect.
EFFECTIVE DATE. This section is effective July 1, 2018."

be covered by the EPSDT program, only if all of the following conditions are
met:

the use of stiripentol is determined to be medically necessary;
(2) stiripentol is covered only for eligible
enrollees with a documented diagnosis of Dravet syndrome, regardless of whether
an SCN1A genetic mutation is found, or children with Malignant Migrating
Partial Epilepsy in Infancy due to an SCN2A genetic mutation;
(3) all other available covered
prescription medications that are medically necessary for the patient have been
tried without successful outcomes; and
(4) the United States Food and Drug
Administration has approved the treating physician's individual patient
investigational new drug application (IND) for the use of stiripentol for
treatment.
This provision related to coverage of stiripentol does not apply to MinnesotaCare coverage under chapter 256L."

Subdivision 1. Rule authority. The commissioner of health shall collect cancer incidence information, analyze the information, and conduct special studies designed to determine the potential public health significance of an increase in cancer incidence.
The commissioner shall adopt rules to administer the system, collect information, and distribute data. The rules must include, but not be limited to, the following:
(1) the type of data to be reported including whether an individual is or was a full-time or volunteer firefighter and the name of the fire department where the individual worked;
(2) standards for reporting specific types of data;
(3) payments allowed to hospitals, pathologists, and registry systems to defray their costs in providing information to the system;
(4) criteria relating to contracts made with outside entities to conduct studies using data collected by the system. The criteria may include requirements for a written protocol outlining the purpose and public benefit of the study, the description, methods, and projected results of the study, peer review by other scientists, the methods and facilities to protect the privacy of the data, and the qualifications of the researcher proposing to undertake the study; and
(5) specification of fees to be charged under section 13.03, subdivision 3, for all out-of-pocket expenses for data summaries or specific analyses of data requested by public and private agencies, organizations, and individuals, and which are not otherwise included in the commissioner's annual summary reports. Fees collected are appropriated to the commissioner to offset the cost of providing the data."

"Sec. 5. Minnesota Statutes 2016, section 256B.072, is amended to read:
256B.072
PERFORMANCE REPORTING AND QUALITY IMPROVEMENT SYSTEM.
Subdivision 1. Establishment and administration. (a) The commissioner of human services shall establish a performance reporting system for health care providers who provide health care services to public program recipients covered under chapters 256B, 256D, and 256L, reporting separately for managed care and fee-for-service recipients.
(b) The measures used for the performance reporting system for medical groups shall include measures of care for asthma, diabetes, hypertension, and coronary artery disease and measures of preventive care services. The measures used for the performance reporting system for inpatient hospitals shall include measures of care for acute myocardial infarction, heart failure, and pneumonia, and measures of care and prevention of surgical infections. In the case of a medical group, the measures used shall be consistent with measures published by nonprofit Minnesota or national organizations that produce and disseminate health care quality measures or evidence-based health care guidelines. In the case of inpatient hospital measures, the commissioner shall appoint the Minnesota Hospital Association and Stratis Health to advise on the development of the performance measures to be used for hospital reporting. To enable a consistent measurement process across the community, the commissioner may use measures of care provided for patients in addition to those identified in paragraph (a). The commissioner shall ensure collaboration with other health care reporting organizations so that the measures described in this section are consistent with those reported by those organizations and used by other purchasers in Minnesota.
(c) The commissioner may require providers to submit information in a required format to a health care reporting organization or to cooperate with the information collection procedures of that organization. The commissioner may collaborate with a reporting organization to collect information reported and to prevent duplication of reporting.
(d) By October 1, 2007, and annually thereafter, the commissioner shall report through a public Web site the results by medical groups and hospitals, where possible, of the measures under this section, and shall compare the results by medical groups and hospitals for patients enrolled in public programs to patients enrolled in private health plans. To achieve this reporting, the commissioner may collaborate with a health care reporting organization that operates a Web site suitable for this purpose.
(e) Performance measures must be stratified as provided under section 62U.02, subdivision 1, paragraph (b), and risk-adjusted as specified in section 62U.02, subdivision 3, paragraph (b).
Subd. 2. Alternative
performance measures. (a) The
commissioner shall develop alternative performance measures for providers who
primarily serve patients who:
(1) are uninsured or enrolled in
Minnesota health care programs; and
(2) display socioeconomic
characteristics associated with poor health outcomes.
The commissioner, beginning July 1, 2018, shall give
providers the option to have their performance measured using these alternative
measures. The commissioner shall develop
and use alternative measures for all provider performance reporting initiatives

(b) Alternative performance measures:
(1) must account for nonclinical patient
characteristics that are correlated with health disparities and have an impact
on provider performance on standardized statewide cost and quality measures;
(2) may include new measures appropriate
to the patient population served, standardized statewide measures that have
been adjusted or modified to account for sociodemographic factors, or a
combination of both types of measures; and
(3) must include one or more measures of
provider initiatives to improve the health of patients and prevent future
chronic disease, in addition to measures related to the quality of care.
(c) The alternative measures must be
developed and used for all:
(1) public reporting of provider
performance;
(2) provider quality measurement and
payment rate determinations under fee-for-service, managed care, and
county-based purchasing; and
(3) provider quality measurement and
payment rate determinations under value-based purchasing and care coordination
arrangements, including but not limited to those initiatives operating under
sections 256B.0751, 256B.0753, 256B.0755, 256B.0756, and 256B.0757.
(d) The commissioner shall establish eligibility criteria for providers to participate in the alternative performance measurement system, and a process for providers to voluntarily opt in. The commissioner may require providers to submit any additional information necessary to determine eligibility for the alternative performance measurement system and to measure provider performance using the alternative measures."
