Subdivision 1. Creation; appointments. (a) The Real Estate Appraisal Advisory Board is created and composed of seven persons appointed by the commissioner. Members are appointed to the board subject to the following conditions:

(1) members must currently be, and have been for the past five years, residents of this state;

(2) the membership of the board must reasonably reflect the geographic distribution of the population of this state;

(3) one member must be currently licensed as, and have been actively engaged and in good standing for the past five years as, a certified general real property appraiser;

(4) two members must be currently licensed as, and have been actively engaged and in good standing for the past five years as, a certified residential real property appraiser;

(5) one member must be currently licensed as, and have been actively engaged and in good standing for the past five years as, a real estate appraiser and as a real estate broker or salesperson under chapter 82;

(6) one member must represent appraisal management companies, as defined in section 82C.02, subdivision 4, as evidenced by the member's employment with an appraisal management company;

(7) one member must represent the interests of the general public and have knowledge of the real estate business; and

(8) the commissioner must be a member.

(b) In making appointments under paragraph (a), clauses (3) and (4), the commissioner must consider recommendations by members and the Minnesota chapters of any nationally recognized real estate appraisal organization.

(c) In making the appointment under paragraph (a), clause (5), the commissioner must consider recommendations by members and organizations representing the real estate industry.

(d) In making the appointment under paragraph (a), clause (6), the commissioner must consider recommendations by members and appraisal management companies.

Subd. 2. Terms. The terms, compensation, and removal of members are governed by section 15.059. Members are limited to serving two full terms on the board. The board does not expire.

Subd. 3. Quorum. A majority of the board members constitutes a quorum. A vacancy in the membership of the board does not impair the right of a quorum to exercise all of the rights and perform all of the duties of the board.

Subd. 4. Meetings. The board shall meet at least quarterly and may be convened by the chairperson or by three members of the board upon ten days' written notice.

Subd. 5. Open meetings. Meetings of the board shall comply with chapter 13D.

Subd. 6. Officers. The board shall, annually at the first meeting of the fiscal year, elect a chair from its members. The chair shall preside over the meetings and shall coordinate with the commissioner in developing and distributing an agenda for each meeting.

Subd. 7. Commissioner's report. The commissioner shall provide a quarterly report to the board that includes a summarized list of:

(1) appraisal courses and seminars that were not approved for continuing education credit and the reason for the denial; and

(2) public disciplinary actions taken by the commissioner against a real estate appraiser.

Subd. 8. Duties. The board shall advise, provide input, and suggest best practices to the commissioner regarding real estate appraisers, including, but not limited to, licensing, public disciplinary matters, continuing education, and industry-related trends.

Sec. 3. FIRST MEETING OF REAL ESTATE APPRAISAL ADVISORY BOARD.

The commissioner of commerce shall convene the first meeting of the Real Estate Appraisal Advisory Board under Minnesota Statutes, section 82B.073. All other meetings shall be convened in accordance with Minnesota Statutes, section 82B.073, subdivision 4."

(a) $9,000,000 in fiscal year 2018 is appropriated from the driver services operating account in the special revenue fund to the commissioner of management and budget for grants to deputy registrars under Minnesota Statutes, section 168.33. This is a onetime appropriation and is available in fiscal year 2019.

(b) The reimbursement to each deputy registrar, as identified by Driver and Vehicle Services designated office location number, is calculated as follows:

(1) 50 percent of available funds allocated proportionally based on (i) the number of transactions where a filing fee under Minnesota Statutes, section 168.33, subdivision 7, is retained by each deputy registrar from August 1, 2017, through January 31, 2018, compared to (ii) the total number of transactions where a filing fee is retained by all deputy registrars during that time period; and

(2) 50 percent of available funds, or 100 percent of available funds if there is insufficient data to perform the calculation under clause (1), allocated proportionally based on (i) the number of transactions where a filing fee is retained by each deputy registrar from July 1, 2014, through June 30, 2017, compared to (ii) the total number of transactions where a filing fee is retained by all deputy registrars during that time period.

(c) For a deputy registrar appointed after July 1, 2014, the commissioner of management and budget must identify whether a corresponding discontinued deputy registrar appointment exists. If a corresponding discontinued deputy registrar is identified, the commissioner must include the transactions of the discontinued deputy registrar in the calculations under paragraph (b) for the deputy registrar appointed after July 1, 2014.

(d) For a deputy registrar appointed after July 1, 2014, for which paragraph (c) does not apply, the commissioner of management and budget must calculate that deputy registrar's proportional share under paragraph (b), clause (2), based on the average number of transactions where a filing fee is retained among the deputy registrars, as calculated excluding any deputy registrars for which this paragraph applies.

(e) In the calculations under paragraph (b), the commissioner of management and budget must exclude transactions for a deputy registrar office operated by the state. A deputy registrar office operated by the state is not eligible to receive funds under this section.

(f) The commissioner of public safety must provide information as necessary for calculations under this section to the commissioner of management and budget.

(g) The commissioner of management and budget must make efforts to reimburse deputy registrars within 30 days of the effective date of this section. The commissioner must use existing resources to administer the reimbursements.

EFFECTIVE DATE. This section is effective the day following final enactment."

(1) require cities and towns to require the separation and separate collection of recyclable materials;

(2) specify the material to be separated; and

(3) require cities and towns to meet any performance standards for source separation that are contained in the county solid waste plan.

(b) A county may itself organize collection under subdivisions 4a to 4d 4f in any city or town that does not comply with a county organized collection ordinance adopted under this subdivision, and the county may implement, as part of its organized collection, the source separation program and performance standards required by its organized collection ordinance.

Sec. 9. EFFECTIVE DATE.

This act is effective January 1, 2019, and applies to organized collection noticed under Minnesota Statutes, section 115A.94, subdivision 2, on or after that date."

Additions and designations under items C and D do not apply to this formula.";

(2) item B must be amended to read: "Designating at least 25 miles of an existing trail for a new motorized recreational use other than snowmobiling.
