1.1    .................... moves to amend H. F. No. 2290 as follows:
1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. [609.553] THEFT OF MEDICAL RECORDS.
1.4    Any person or contractor who (1) represents an employer of employees who are
1.5exempt from coverage under section 176.041, and (2) with intent to defraud, requests or
1.6receives an employee's medical data which the person, contractor, or employer is not
1.7entitled by knowingly misrepresenting, misstating, or failing to disclose any material
1.8fact is guilty of theft and shall be prosecuted and sentenced pursuant to section 609.52.
1.9An alleged violation of this subdivision may be prosecuted by a county attorney with
1.10appropriate jurisdiction or by the attorney general. In addition, the injured party may bring
1.11a civil action in a court of competent jurisdiction."
1.12Amend the title accordingly
