1.4 "Sec. 79.
VOLUNTARY TERMINATION OF TIMBER SALE PERMITS.
1.5 (a) Notwithstanding Minnesota Statutes, sections 90.161, 90.173, and 90.211, or
1.6other law to the contrary, the commissioner of natural resources shall, in the case of
1.7nontrust land, terminate the permit for an eligible sale of timber without penalty according
1.8to this section and upon request of the permit holder. In the case of a permit relating
1.9to trust land, the commissioner shall terminate the permit for an eligible sale of timber
1.10according to this section only if termination of the permit would secure the maximum
1.11long-term economic return from the land consistent with the fiduciary responsibilities
1.12imposed by law in regard to the trust lands.
1.13 (b) An "eligible sale" means a sale for timber:
1.14 (1) the permit for which was issued on or after October 1, 2004, but before March
1.1531, 2006;
1.16 (2) that contains aspen as the predominant timber species;
1.17 (3) for which the aspen was sold for $40 per cord or more; and
1.18 (4) for which no harvest activities or activities incidental to harvest have occurred.
1.19 (c) The maximum amount available for voluntary turn back under this section is
1.207,500 cords of all species for each permittee.
1.21 (d) In the case of a 100 percent secured sale, the permittee may choose to be released
1.22from the security of any permit consistent with paragraph (b), except that the permittee
1.23must pay 15 percent of the appraised value of the permit, plus eight percent interest from
1.24date of purchase to date of conversion under this paragraph, in cash, to the commissioner.
1.25 (e) In the case of any sale, including a sale under paragraph (d), for which the
1.26commissioner has received a 15 percent down payment and that meets the criteria in
1.27paragraph (b), the permit holder may request a credit equal to two-thirds of the down
2.1payment. Amounts credited to permittees under this paragraph must first be applied to
2.2any existing sales that remain in the permittee's account and may then be used toward
2.3future timber purchases. Credits under this paragraph expire two years after the effective
2.4date of the permit termination.
2.5 (f) All permit terminations under this section must be completed by December 31,
2.62007. The commissioner of natural resources must proceed expeditiously to reoffer for
2.7sale any timber subject of a turn back under this section.
2.8EFFECTIVE DATE.This section is effective the day following final enactment."
