1.4 Subdivision 1.
Endorsement; reciprocity. (a) The board may issue a license to
1.5practice medicine to any person who satisfies the requirements in paragraphs (b) to (f).
1.6 (b) The applicant shall satisfy all the requirements established in section
147.02,
1.7subdivision 1
, paragraphs (a), (b), (d), (e), and (f).
1.8 (c) The applicant shall:
1.9 (1) have passed an examination prepared and graded by the Federation of State
1.10Medical Boards, the National Board of Medical Examiners, or the United States Medical
1.11Licensing Examination
(USMLE) program in accordance with section
147.02, subdivision
1.121
, paragraph (c), clause (2); the National Board of Osteopathic Examiners; or the Medical
1.13Council of Canada; and
1.14 (2) have a current license from the equivalent licensing agency in another state or
1.15Canada and, if the examination in clause (1) was passed more than ten years ago, either:
1.16 (i) pass the Special Purpose Examination of the Federation of State Medical Boards
1.17with a score of 75 or better within three attempts; or
1.18 (ii) have a current certification by a specialty board of the American Board of
1.19Medical Specialties, of the American Osteopathic Association Bureau of Professional
1.20Education, the Royal College of Physicians and Surgeons of Canada, or of the College of
1.21Family Physicians of Canada
.; or
1.22 (3) if the applicant fails to meet the requirement established in section 147.02,
1.23subdivision 1, paragraph (c), clause (2), because the applicant failed to pass each of steps
1.24one, two, and three of the USMLE within the required three attempts, the applicant may
1.25be granted a license provided the applicant:
1.26 (i) has passed each of steps one, two, and three with passing scores as recommended
1.27by the USMLE program within no more than four attempts for any of the three steps;
2.1 (ii) is currently licensed in another state; and
2.2 (iii) has current certification by a specialty board of the American Board of Medical
2.3Specialties, the American Osteopathic Association Bureau of Professional Education, the
2.4Royal College of Physicians and Surgeons of Canada, or the College of Family Physicians
2.5of Canada.
2.6 (d) The applicant shall pay a fee established by the board by rule. The fee may
2.7not be refunded.
2.8 (e) The applicant must not be under license suspension or revocation by the licensing
2.9board of the state or jurisdiction in which the conduct that caused the suspension or
2.10revocation occurred.
2.11 (f) The applicant must not have engaged in conduct warranting disciplinary action
2.12against a licensee, or have been subject to disciplinary action other than as specified in
2.13paragraph (e). If an applicant does not satisfy the requirements stated in this paragraph,
2.14the board may issue a license only on the applicant's showing that the public will be
2.15protected through issuance of a license with conditions or limitations the board considers
2.16appropriate.
2.17 (g) Upon the request of an applicant, the board may conduct the final interview of
2.18the applicant by teleconference.
2.19EFFECTIVE DATE.This section is effective the day following final enactment.
2.20 Sec. 2. Minnesota Statutes 2007 Supplement, section 147.037, subdivision 1, is
2.21amended to read:
2.22 Subdivision 1.
Requirements. The board shall issue a license to practice medicine
2.23to any person who satisfies the requirements in paragraphs (a) to (g).
2.24 (a) The applicant shall satisfy all the requirements established in section
147.02,
2.25subdivision 1
, paragraphs (a), (e), (f), (g), and (h).
2.26 (b) The applicant shall present evidence satisfactory to the board that the applicant
2.27is a graduate of a medical or osteopathic school approved by the board as equivalent
2.28to accredited United States or Canadian schools based upon its faculty, curriculum,
2.29facilities, accreditation, or other relevant data. If the applicant is a graduate of a medical or
2.30osteopathic program that is not accredited by the Liaison Committee for Medical Education
2.31or the American Osteopathic Association, the applicant may use the Federation of State
2.32Medical Boards' Federation Credentials Verification Service (FCVS) or its successor. If
2.33the applicant uses this service as allowed under this paragraph, the physician application
2.34fee may be less than $200 but must not exceed the cost of administering this paragraph.
3.1 (c) The applicant shall present evidence satisfactory to the board that the applicant
3.2has been awarded a certificate by the Educational Council for Foreign Medical Graduates,
3.3and the applicant has a working ability in the English language sufficient to communicate
3.4with patients and physicians and to engage in the practice of medicine.
3.5 (d) The applicant shall present evidence satisfactory to the board of the completion
3.6of two years of graduate, clinical medical training in a program located in the United
3.7States, its territories, or Canada and accredited by a national accrediting organization
3.8approved by the board. This requirement does not apply:
3.9 (1) to an applicant who is admitted as a permanent immigrant to the United States on
3.10or before October 1, 1991, as a person of exceptional ability in the sciences according to
3.11Code of Federal Regulations, title 20, section
656.22(d);
3.12 (2) to an applicant holding a valid license to practice medicine in another country
3.13and issued a permanent immigrant visa after October 1, 1991, as a person of extraordinary
3.14ability in the field of science or as an outstanding professor or researcher according to
3.15Code of Federal Regulations, title 8, section
204.5(h) and (i), or a temporary nonimmigrant
3.16visa as a person of extraordinary ability in the field of science according to Code of
3.17Federal Regulations, title 8, section
214.2(o),
3.18provided that a person under clause (1) or (2) is admitted pursuant to rules of the United
3.19States Department of Labor; or
3.20 (3) to an applicant who is licensed in another state, has practiced five years without
3.21disciplinary action in the United States, its territories, or Canada, has completed one year
3.22of the graduate, clinical medical training required by this paragraph, and has passed the
3.23Special Purpose Examination of the Federation of State Medical Boards within three
3.24attempts in the 24 months before licensing.
3.25 (e) The applicant must:
3.26 (1) have passed an examination prepared and graded by the Federation of State
