1.3 "Section 1. Minnesota Statutes 2006, section 256B.035, is amended to read:
1.4256B.035 MANAGED CARE.
1.5 (a) The commissioner of human services may contract with public or private
1.6entities or operate a preferred provider program to deliver health care services to medical
1.7assistance, general assistance medical care, and MinnesotaCare program recipients. The
1.8commissioner may enter into risk-based and non-risk-based contracts. Contracts may be
1.9for the full range of health services, or a portion thereof, for medical assistance and general
1.10assistance medical care populations to determine the effectiveness of various provider
1.11reimbursement and care delivery mechanisms. The commissioner may seek necessary
1.12federal waivers and implement projects when approval of the waivers is obtained from
1.13the Centers for Medicare and Medicaid Services of the United States Department of
1.14Health and Human Services.
1.15 (b) The commissioner is prohibited from providing the names of potential enrollees
1.16to health plans for marketing purposes. The commissioner may mail marketing materials
1.17to potential enrollees on behalf of health plans, in which case the health plans shall cover
1.18any costs incurred by the commissioner for mailing marketing materials.
1.19 Sec. 2. Minnesota Statutes 2006, section 256B.04, is amended by adding a subdivision
1.20to read:
1.21 Subd. 20. Managed care; marketing. The commissioner and the Department
1.22of Human Services is prohibited from providing the names of potential enrollees to
1.23health plans for marketing purposes. The commissioner may mail marketing materials to
1.24potential enrollees on behalf of health plans, in which case the health plans shall cover any
1.25costs incurred by the commissioner for mailing marketing materials."
