1.3    "(f) A violation under this subdivision may not be used to enhance a petty
1.4misdemeanor violation of chapter 169 to a misdemeanor pursuant to section 169.89,
1.5subdivision 1, clause (2)."
1.6Page 3, after line 19, insert:

1.7    "Sec. 5. Minnesota Statutes 2006, section 169.89, subdivision 1, is amended to read:
1.8    Subdivision 1. Violation; when petty misdemeanor enhanced to misdemeanor.
1.9    Unless otherwise declared in this chapter with respect to particular offenses, it is a petty
1.10misdemeanor for any person to do any act forbidden or fail to perform any act required by
1.11this chapter; except that:
1.12    (1) a violation which is committed in a manner or under circumstances so as to
1.13endanger or be likely to endanger any person or property; or
1.14    (2) exclusive of violations of 169.06, subdivision 4a, and violations relating to the
1.15standing or parking of an unattended vehicle, a violation of any of the provisions of this
1.16chapter, classified therein as a petty misdemeanor, when preceded by two or more petty
1.17misdemeanor convictions within the immediate preceding 12-month period;
1.18is a misdemeanor to which the provisions of subdivision 2 shall not apply."

1.20Amend the title accordingly
