1.9 Sec. 2. Minnesota Statutes 2006, section 171.05, subdivision 2b, is amended to read:
1.10 Subd. 2b.
Instruction permit use by person under age 18. (a) This subdivision
1.11applies to persons who have applied for and received an instruction permit under
1.12subdivision 2.
1.13 (b) The permit holder may, with the permit in possession, operate a motor vehicle,
1.14but must be accompanied by and be under the supervision of a certified driver education
1.15instructor, the permit holder's parent or guardian, or another licensed driver age 21 or
1.16older. The supervisor must occupy the seat beside the permit holder.
1.17 (c) The permit holder may operate a motor vehicle only when every occupant under
1.18the age of 18 has a seat belt or child passenger restraint system properly fastened. A
1.19person who violates this paragraph is subject to a fine of $25. A peace officer may
1.20not issue a citation for a violation of this paragraph unless the officer lawfully stopped
1.21or detained the driver of the motor vehicle for a moving violation as defined in section
1.22171.04, subdivision 1
. The commissioner shall not record a violation of this paragraph on
1.23a person's driving record.
1.24 (d) The permit holder may not operate a vehicle while communicating over, or
1.25otherwise operating, a cellular or wireless telephone, whether handheld or hands free,
1.26when the vehicle is in motion. The permit holder may assert as an affirmative defense that
2.1the violation was made for the sole purpose of obtaining emergency assistance to prevent
2.2a crime about to be committed, or in the reasonable belief that a person's life or safety
2.3was in danger.
Violation of this paragraph is a petty misdemeanor subject to section
2.4169.89, subdivision 2.
2.5 (e) The permit holder may not drive with more than two passengers except when:
2.6 (1) accompanied by a family member who is 21 years of age or older;
2.7 (2) accompanied by an adult who is 25 years of age or older; or
2.8 (3) the holder has in possession a signed statement from the holder's parent or
2.9guardian authorizing the holder to operate a motor vehicle with more than two passengers.
2.10 (f) The permit holder may not drive between 12:00 a.m. and 5:00 a.m. except when:
2.11 (1) accompanied by a family member who is 21 years of age or older;
2.12 (2) accompanied by an adult who is 25 years of age or older and is designated by
2.13a parent or guardian; or
2.14 (3) the holder has in possession a signed statement from the holder's parent or
2.15guardian authorizing the holder to operate a motor vehicle between 12:00 a.m. and 5:00
2.16a.m.
2.17 (e) (g) The permit holder must maintain a driving record free of convictions for
2.18moving violations, as defined in section
171.04, subdivision 1, and free of convictions
2.19for violation of section
169A.20,
169A.33,
169A.35, or sections
169A.50 to
169A.53. If
2.20the permit holder drives a motor vehicle in violation of the law, the commissioner shall
2.21suspend, cancel, or revoke the permit in accordance with the statutory section violated.
