1.11    "Sec. 15. Minnesota Statutes 2006, section 353.656, subdivision 1, is amended to read:
1.12    Subdivision 1. In line of Duty disability; computation of benefits. (a) A member
1.13of the police and fire plan who:
1.14    (1) has not met the requirements for a retirement annuity under section 353.651,
1.15subdivision 1, or
1.16    (2) has met the requirements for a retirement annuity under section 353.651,
1.17subdivision 1, but who does not have 20 years of credited service; and who becomes
1.18disabled and physically unfit to perform duties as a police officer, firefighter, or paramedic
1.19as defined under section 353.64, subdivision 10, as a direct result of an injury, sickness, or
1.20other disability incurred in or arising out of any act of duty, which has or is expected to
1.21render the member physically or mentally unable to perform the duties as a police officer,
1.22firefighter, or paramedic as defined under section 353.64, subdivision 10, for a period of at
1.23least one year is determined to qualify for duty disability as defined in section 353.01,
1.24subdivision 41, shall receive disability benefits during the period of such disability.
1.25    (b) The benefits must be in an amount equal to 60 percent of the "average salary" as
1.26defined in section 353.01, subdivision 17a, plus an additional percent specified in section
1.27356.315, subdivision 6, of that average salary for each year of service in excess of 20 years.
2.1    (b) To be eligible for a benefit under paragraph (a), the member must have:
2.2    (1) not met the requirements for a retirement annuity under section 353.651,
2.3subdivision 1; or
2.4    (2) met the requirements under that subdivision, but does not have at least 20 years
2.5of allowable service credit.
2.6    (c) If paragraph (b), clause (2), applies, the disability benefit must be paid for a
2.7period of 60 months from the disability benefit accrual date and at the end of that period
2.8is subject to provisions of subdivision 5a.
2.9    (d) If the disability under this subdivision occurs before the member has at least five
2.10years of allowable service credit in the police and fire plan, the disability benefit must be
2.11computed on the "average salary" from which deductions were made for contribution to
2.12the police and fire fund.
2.13EFFECTIVE DATE.This section is effective July 1, 2007, and applies to disability
2.14benefit applicants whose last day of public employment was after June 30, 2007."
