1.4    "Sec. 9. Minnesota Statutes 2006, section 122A.40, subdivision 8, is amended to read:
1.5    Subd. 8. Peer Review for continuing contract teachers. (a) A school board and
1.6an exclusive representative of the teachers in the district shall develop an annual review
1.7process and evaluation for all continuing contract teachers through joint agreement. The
1.8annual review process and evaluation must be aligned to best instructional practices in
1.9teaching and learning. A school board and exclusive representatives of the teachers must
1.10use section 122A.413, subdivision 2, as the review for continuing contract teachers if the
1.11plan has been approved by the commissioner of education.
1.12    (b) A school board and an exclusive representative of the teachers in the district shall
1.13develop a peer review process for continuing contract teachers through joint agreement.
1.14Peer review for continuing contract teachers may be used to meet the requirements
1.15in paragraph (a)."
