1.3 "Sec. 4. Minnesota Statutes 2006, section 90.151, subdivision 1, is amended to read:
1.4 Subdivision 1.
Issuance; expiration. (a) Following receipt of the down payment
1.5for state timber required under section
90.14 or
90.191, the commissioner shall issue a
1.6numbered permit to the purchaser, in a form approved by the attorney general, by the
1.7terms of which the purchaser shall be authorized to enter upon the land, and to cut and
1.8remove the timber therein described as designated for cutting in the report of the state
1.9appraiser, according to the provisions of this chapter. The permit shall be correctly
1.10dated and executed by the commissioner and signed by the purchaser. If a permit is not
1.11signed by the purchaser within 60 days from the date of purchase, the permit cancels
1.12and the down payment for timber required under section
90.14 forfeits to the state.
The
1.13commissioner may grant an additional period for the purchaser to sign the permit, not to
1.14exceed five business days, provided the purchaser pays a $250 penalty fee.
1.15 (b) The permit shall expire no later than five years after the date of sale as the
1.16commissioner shall specify or as specified under section
90.191, and the timber shall
1.17be cut within the time specified therein. All cut timber, equipment, and buildings not
1.18removed from the land within 90 days after expiration of the permit shall become the
1.19property of the state.
1.20 (c) The commissioner may grant an additional period of time not to exceed 120 days
1.21for the removal of cut timber, equipment, and buildings upon receipt of such request by
1.22the permit holder for good and sufficient reasons. The commissioner may grant a second
1.23period of time not to exceed 120 days for the removal of cut timber, equipment, and
1.24buildings upon receipt of a request by the permit holder for hardship reasons only.
1.25EFFECTIVE DATE.This section is effective the day following final enactment
1.26and applies retroactively to permits dated January 1, 2008, and thereafter."
