1.3Delete everything after the enacting clause and insert:
1.4 "Section 1. Minnesota Statutes 2006, section 13.785, is amended by adding a
1.5subdivision to read:
1.6 Subd. 4. Deceased veterans data. Data relating to veterans deceased as a result of
1.7service-connected causes are classified under section 197.225.
1.8EFFECTIVE DATE.This section is effective the day following final enactment.
1.9 Sec. 2.
[197.225] LIST OF DECEASED MILITARY PERSONNEL.
1.10 (a) The commissioner of veterans affairs shall collect and maintain data about
1.11Minnesota residents who have died of service-connected causes while serving in the
1.12United States armed forces. The data may include deceased service members who are
1.13the immediate family members of Minnesota residents, but who themselves were not
1.14Minnesota residents at the time of death. The commissioner shall collect the following
1.15data: the individual's full name, military rank, branch of service, age at the time of death,
1.16and Minnesota hometown or if not a Minnesota resident at the time of death, the service
1.17member's home state.
1.18 (b) Data collected pursuant to this section are nonpublic data, but may be
1.19disseminated to the individual's next of kin, and for ceremonial or honorary purposes to
1.20veterans' organizations, civic organizations, the news media, and researchers. No other
1.21use or dissemination of the data is permitted.
1.22 (c) The next of kin of a veteran whose data is collected may request that the data
1.23not be disseminated for any purpose. Upon receiving such a request, the Department of
1.24Veterans Affairs must exclude the deceased veteran's data from any data disseminated for
1.25ceremonial or honorary purposes as permitted by paragraph (b).
2.1 (d) Data collected pursuant to this section shall not be indicative of any person's
2.2status with regard to qualification for veterans benefits or other benefits.
2.3EFFECTIVE DATE.This section is effective the day following final enactment."
