1.2Delete everything after the enacting clause and insert:
1.3 "Section 1. Minnesota Statutes 2006, section 168.27, is amended by adding a
1.4subdivision to read:
1.5 Subd. 30. Glazing material. A new motor vehicle dealer, used motor vehicle
1.6dealer, or motor vehicle lessor may not sell or lease a motor vehicle that does not meet the
1.7glazing material requirements under section 169.71, subdivision 4.
1.8 Sec. 2. Minnesota Statutes 2006, section 169.71, subdivision 4, is amended to read:
1.9 Subd. 4.
Glazing material; prohibitions and exceptions. (a) No person shall drive
1.10or operate any motor vehicle required to be registered in the state of Minnesota upon any
1.11street or highway under the following conditions:
1.12 (1) when the windshield is composed of, covered by, or treated with any material
1.13which has the effect of making the windshield more reflective or in any other way reducing
1.14light transmittance through the windshield;
1.15 (2) when any window on the vehicle is composed of, covered by, or treated with any
1.16material that has a highly reflective or mirrored appearance;
1.17 (3) when any side window or rear window is composed of or treated with any
1.18material so as to obstruct or substantially reduce the driver's clear view through the
1.19window or has a light transmittance of less than 50 percent plus or minus three percent in
1.20the visible light range or a luminous reflectance of more than 20 percent plus or minus
1.21three percent; or
1.22 (4) when any material has been applied after August 1, 1985, to any motor vehicle
1.23window without an accompanying permanent marking which indicates the percent of
1.24transmittance and the percent of reflectance afforded by the material. The marking must
1.25be in a manner so as not to obscure vision and be readable when installed on the vehicle.
1.26 (b) This subdivision does not apply to glazing materials which:
2.1 (1) have not been modified since the original installation
, nor to original replacement
2.2windows and windshields, that were originally installed or replaced or original
2.3replacement if:
2.4 (i) the original installation was performed by a first-stage manufacturer, as defined in
2.5section 168.011, subdivision 31; and
2.6 (ii) the original installation or replacement was in conformance with Federal Motor
2.7Vehicle Safety Standard 205;
2.8 (2) are required to satisfy prescription or medical needs of the driver of the vehicle
2.9or a passenger if
:
2.10 (i) the driver or passenger is in possession of the prescription or a physician's
2.11statement of medical need;
2.12 (ii) the prescription or statement specifically states the minimum percentage that
2.13light transmittance may be reduced to satisfy the prescription or medical needs of the
2.14patient; and
2.15 (iii) the prescription or statement contains an expiration date, which must be no more
2.16than two years after the date the prescription or statement was issued; or
2.17 (3) are applied to:
2.18 (i) the rear windows of a pickup truck as defined in section
168.011, subdivision 29;
2.19 (ii) the rear windows or the side windows on either side behind the driver's seat of a
2.20van as defined in section
168.011, subdivision 28;
2.21 (iii) the side and rear windows of a vehicle used to transport human remains by a
2.22funeral establishment holding a license under section
149A.50; or
2.23 (iv) the side and rear windows of a limousine as defined in section
168.011,
2.24subdivision 35
.; or
2.25 (v) the rear and side windows of a police vehicle."
