1.2(A08-1172), as follows:
1.3Page 24, delete section 24 and insert:

1.4    "Sec. 24. [256B.0948] STATEWIDE HEALTH INFORMATION EXCHANGE.
1.5    Subdivision 1. Commissioner's authority to join and participate. The
1.6commissioner of human services has the authority to join and participate as a member
1.7in a legal entity developing and operating a statewide health information exchange that
1.8shall meet the following criteria:
1.9    (1) the legal entity must meet all constitutional and statutory requirements to allow
1.10the commissioner to participate, including, without limitation, the Minnesota Constitution,
1.11article X, section 1;
1.12    (2) the commissioner or the commissioner's designated representative must have
1.13the right to participate in the governance of the legal entity under the same terms and
1.14conditions and subject to the same requirements as any other member in the legal entity
1.15and in that role shall act to advance state interests and lessen the burdens of government.
1.16    Subd. 2. Development expenses. Notwithstanding chapter 16C, the commissioner
1.17may pay the state's prorated share of development related expenses of the legal entity
1.18retroactive to October 29, 2007, regardless of the date the commissioner joins the legal
1.19entity as a member."
