1.2Delete everything after the enacting clause and insert:
1.3 "Section 1.
[144.673] CANCER RISK ASSESSMENT.
1.4 Subdivision 1. Definitions. (a) For purposes of this section, the following terms
1.5have the meanings given them.
1.6 (b) "Known carcinogen" means a substance categorized as a known human
1.7carcinogen by at least one of the following agencies: United States Environmental
1.8Protection Agency; United States Department of Health and Human Services, National
1.9Toxicology Program; or World Health Organization International Agency for Research
1.10on Cancer.
1.11 (c) "Probable carcinogen" means a substance categorized as a probable human
1.12carcinogen or a likely human carcinogen by at least one of the following agencies: United
1.13States Environmental Protection Agency; United States Department of Health and Human
1.14Services, National Toxicology Program; or World Health Organization International
1.15Agency for Research on Cancer.
1.16 Subd. 2. Risk level. The commissioner of health shall assess the risk of human
1.17cancer from known and probable carcinogens in the air, water, or soil using the following
1.18formula: a lifetime risk level of 10-6, so that no more than one out of every 1,000,000
1.19people exposed to a substance or chemical over a lifetime would be estimated to develop
1.20cancer from that exposure.
1.21 Subd. 3. Implementation. The risk level established in this section shall apply to
1.22permits and licenses issued on or after August 1, 2009. Any permits or licenses issued
1.23prior to August 1, 2009, that are affected by this section shall remain valid until the permit
1.24or license is renewed, revised, or reissued.
1.25EFFECTIVE DATE.This section is effective August 1, 2008."
