1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. Minnesota Statutes 2006, section 626.89, subdivision 9, is amended to read:
1.4    Subd. 9. Presence of attorney or and union representative. The officer whose
1.5formal statement is taken has the right to have an attorney or a union representative of the
1.6officer's choosing or an attorney retained by the officer, or both, present during the session.
1.7The officer may request the presence of an the attorney or the union representative, or
1.8both, at any time before or during the session. When a request under this subdivision is
1.9made, no formal statement may be taken until a reasonable opportunity is provided for the
1.10officer to obtain the presence of the attorney or the union representative."
