1.2Delete everything after the enacting clause and insert:
1.3 "Section 1. Minnesota Statutes 2006, section 18C.60, is amended by adding a
1.4subdivision to read:
1.5 Subd. 5. Retail signage. (a) A wholesaler of lawn fertilizer containing phosphorus
1.6must provide to each retail establishment offering its product for sale a conspicuous sign
1.7stating the legal limitations on the fertilizer's use. "Conspicuous" means lettering in black
1.8arial typeface at least three-eighths of an inch in height against a bright contrasting
1.9background. The sign must state:
1.10 "For the protection of water quality, Minnesota law prohibits application of lawn
1.11fertilizer containing phosphorus except when:
1.12 (1) establishing a new lawn with seed or sod;
1.13 (2) a soil test or plant tissue test shows a need for phosphorus;
1.14 (3) applied on a golf course by a trained person; or
1.15 (4) applied on farms growing sod for sale."
1.16 (b) A retailer offering lawn fertilizer containing phosphorus must post a sign with
1.17the fertilizer display.
1.18 (c) A wholesaler must provide instructions for posting the sign as described in
1.19this subdivision and contact information for the Department of Agriculture where more
1.20information can be obtained.
1.21 (d) A retailer may substitute signs provided by a wholesaler with an alternative sign
1.22that meets requirements of paragraph (a).
1.23 Sec. 2.
REPEALER.
1.24Minnesota Statutes 2006, section 18C.60, subdivision 4, is repealed."
1.25Delete the title and insert:
1.27relating to agriculture; requiring wholesalers of lawn fertilizer containing
1.28phosphorus to provide retail signage;amending Minnesota Statutes 2006, section
1.2918C.60, by adding a subdivision; repealing Minnesota Statutes 2006, section
1.3018C.60, subdivision 4."
