1.4    "Sec. 79. ROAD CONSTRUCTION BIDS; CITY ORDINANCE.
1.5    Notwithstanding any other law, the commissioner of transportation shall accept the
1.6low bid amount among any cancelled bids for a cooperative road construction project
1.7involving a city of the first class located outside of the metropolitan area, as defined in
1.8Minnesota Statutes, section 473.121, subdivision 2, if:
1.9    (1) the bid cancellation occurred after July 1, 2007, as a result of a city ordinance
1.10relating to green space setback;
1.11    (2) the city changes the ordinance before October 1, 2008, in such a manner that a bid
1.12cancellation would not occur were the same bids submitted under the revised ordinance.
1.13EFFECTIVE DATE.This section is effective the day following final enactment."
