1.4    "Sec. 58. Minnesota Statutes 2006, section 221.011, subdivision 26, is amended to read:
1.5    Subd. 26. Private carrier. (a) "Private carrier" means a person engaged in the
1.6transportation of property or passengers by motor vehicle when:
1.7    (1) the person transporting the property or passengers is engaged in a business other
1.8than transportation; and
1.9    (2) the transportation is within the scope of and furthers a primary business, other
1.10than transportation, of that person.; or
1.11    (2) the person transporting the property or passengers by motor vehicle is a charitable
1.12organization exempt from taxation under section 501(c)(3) of the Internal Revenue Code
1.13and the transportation furthers the charitable organization's charitable mission.
1.14    (b) "Private carrier" does not include a person while engaged in transportation
1.15described in section 221.025. "
1.16Renumber the sections in sequence and correct the internal references
1.17Amend the title accordingly
