1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. Minnesota Statutes 2008, section 245A.144, is amended to read:
1.4245A.144 SUDDEN INFANT DEATH AND SHAKEN BABY SYNDROME
1.5FOR CHILD FOSTER CARE PROVIDERS.
1.6    (a) Licensed child foster care providers that care for infants or children through five
1.7years of age must document that before staff persons and caregivers assist in the care of
1.8infants or children through five years of age, they are instructed on the standards in section
1.9245A.1435 and receive training on reducing the risk of sudden infant death syndrome and
1.10shaken baby syndrome for infants and young children. This section does not apply to
1.11emergency relative foster care under section 245A.035. The training on reducing the risk
1.12of sudden infant death syndrome and shaken baby syndrome may be provided as:
1.13    (1) orientation training to child foster care providers, who care for infants or children
1.14through five years of age, under Minnesota Rules, part 2960.3070, subpart 1; or
1.15    (2) in-service training to child foster care providers, who care for infants or children
1.16through five years of age, under Minnesota Rules, part 2960.3070, subpart 2.
1.17    (b) Training required under this section must be at least one hour in length and must
1.18be completed at least once every five years. At a minimum, the training must address the
1.19risk factors related to sudden infant death syndrome and shaken baby syndrome, means
1.20of reducing the risk of sudden infant death syndrome and shaken baby syndrome, and
1.21license holder communication with parents regarding reducing the risk of sudden infant
1.22death syndrome and shaken baby syndrome.
1.23    (c) Training for child foster care providers must be approved by the county licensing
1.24agency and fulfills, in part, training required under Minnesota Rules, part 2960.3070.

1.25    Sec. 2. Minnesota Statutes 2008, section 245A.1444, is amended to read:
2.1245A.1444 TRAINING ON RISK OF SUDDEN INFANT DEATH SYNDROME
2.2AND SHAKEN BABY SYNDROME BY OTHER PROGRAMS.
2.3    A licensed chemical dependency treatment program that serves clients with infants
2.4 or children through five years of age, who sleep at the program and a licensed children's
2.5residential facility that serves infants or children through five years of age, must document
2.6that before program staff persons or volunteers assist in the care of infants or children
2.7through five years of age, they are instructed on the standards in section 245A.1435 and
2.8receive training on reducing the risk of sudden infant death syndrome and shaken baby
2.9syndrome. The training conducted under this section may be used to fulfill training
2.10requirements under Minnesota Rules, parts 2960.0100, subpart 3; and 9530.6490, subpart
2.114, item B.
2.12    This section does not apply to child care centers or family child care programs
2.13governed by sections 245A.40 and 245A.50.

2.14    Sec. 3. Minnesota Statutes 2008, section 245A.40, subdivision 5, is amended to read:
2.15    Subd. 5. Sudden infant death syndrome and shaken baby syndrome training.
2.16    (a) License holders must document that before staff persons care for infants, they are
2.17instructed on the standards in section 245A.1435 and receive training on reducing the risk
2.18of sudden infant death syndrome and. In addition, license holders must document that
2.19before staff persons care for infants or children through five years of age, they receive
2.20training on the risk of shaken baby syndrome. The training in this subdivision may
2.21be provided as orientation training under subdivision 1 and in-service training under
2.22subdivision 7.
2.23    (b) Sudden infant death syndrome reduction training required under this subdivision
2.24must be at least one one-half hour in length and must be completed at least once every
2.25five years. At a minimum, the training must address the risk factors related to sudden
2.26infant death syndrome and shaken baby syndrome, means of reducing the risk of sudden
2.27infant death syndrome and shaken baby syndrome in child care, and license holder
2.28communication with parents regarding reducing the risk of sudden infant death syndrome
2.29and shaken baby syndrome.
2.30    (c) Shaken baby syndrome training under this subdivision must be at least one-half
2.31hour in length and must be completed at least once every five years. At a minimum, the
2.32training must address the risk factors related to shaken baby syndrome for infants and
2.33young children, means to reduce the risk of shaken baby syndrome in child care, and
2.34license holder communication with parents regarding reducing the risk of shaken baby
2.35syndrome.
3.1(d) The commissioner shall make available for viewing a video presentation on the
3.2dangers associated with shaking infants and young children. The video presentation must
3.3be part of the orientation and annual in-service training of licensed child care centers
3.4center staff persons caring for children under school age. The commissioner shall provide
3.5to child care providers and interested individuals, at cost, copies of a video approved by
3.6the commissioner of health under section 144.574 on the dangers associated with shaking
3.7infants and young children.

3.8    Sec. 4. Minnesota Statutes 2008, section 245A.50, subdivision 5, is amended to read:
3.9    Subd. 5. Sudden infant death syndrome and shaken baby syndrome training.
3.10    (a) License holders must document that before staff persons, caregivers, and helpers
3.11assist in the care of infants, they are instructed on the standards in section 245A.1435 and
3.12receive training on reducing the risk of sudden infant death syndrome and. In addition,
3.13license holders must document that before staff persons, caregivers, and helpers assist in
3.14the care of infants and children under school age, they receive training on reducing the
3.15risk of shaken baby syndrome. The training in this subdivision may be provided as initial
3.16training under subdivision 1 or ongoing training under subdivision 7.
3.17    (b) Sudden infant death syndrome reduction training required under this subdivision
3.18must be at least one one-half hour in length and must be completed at least once every
3.19five years. At a minimum, the training must address the risk factors related to sudden
3.20infant death syndrome and shaken baby syndrome, means of reducing the risk of sudden
3.21infant death syndrome and shaken baby syndrome in child care, and license holder
3.22communication with parents regarding reducing the risk of sudden infant death syndrome
3.23and shaken baby syndrome.
3.24    (c) Shaken baby syndrome training required under this subdivision must be at
3.25least one-half hour in length and must be completed at least once every five years. At a
3.26minimum, the training must address the risk factors related to shaken baby syndrome,
3.27means of reducing the risk of shaken baby syndrome in child care, and license holder
3.28communication with parents regarding reducing the risk of shaken baby syndrome.
3.29(d) Training for family and group family child care providers must be approved
3.30by the county licensing agency.
3.31    (d) (e) The commissioner shall make available for viewing by all licensed child
3.32care providers a video presentation on the dangers associated with shaking infants and
3.33young children. The video presentation shall be part of the initial and ongoing training
3.34of licensed child care providers caring for children under school age. The commissioner
3.35shall provide to child care providers and interested individuals, at cost, copies of a video
4.1approved by the commissioner of health under section 144.574 on the dangers associated
4.2with shaking infants and young children."
