1.2Delete everything after the enacting clause and insert:
1.3 "Section 1.
TECHNICAL ADVISORY GROUP; WATER REGULATION.
1.4(a) The Clean Water Legacy Council shall appoint a technical advisory group
1.5to conduct a study. The technical advisory group must include representatives of the
1.6Department of Natural Resources, Pollution Control Agency, Board of Water and Soil
1.7Resources, Environmental Quality Board, Department of Agriculture, and Department
1.8of Health and nonstate, nonfederal, technical professionals with scientific expertise
1.9in water resources management. Other members may include, but are not limited to,
1.10representatives of the United States Environmental Protection Agency, the Army Corps of
1.11Engineers, and the United States Department of Agriculture.
1.12(b) Members of the technical advisory group serve without compensation.
1.13(c) The study must:
1.14(1) consider scientific data, including the studies of the National Academy of
1.15Sciences relating to watersheds, total maximum daily loads (TMDL's), stormwater, and
1.16compensation for wetland loss under the Clean Water Act;
1.17(2) identify current rules relating to water, the purpose of the rules, the statutory
1.18background of the rules, the outcomes the rules are intended to achieve, the costs of the
1.19rules to state and local government and to the private sector, and the rules' relationship
1.20to other state and federal laws, including requirements relating to training, development,
1.21public education, and record keeping;
1.22(3) assess the pros and cons of a watershed approach to implementing statutory
1.23water management programs and regulations compared to state agency-administered
1.24programs and administrative rules;
1.25(4) assess why some regulations are deemed appropriate for administration at the
1.26local level, for example, those relating to shorelands, floodplains, wild and scenic rivers,
2.1wetland conservation, feedlots, and subsurface sewage treatment systems, and others
2.2are not;
2.3(5) identify current efforts to eliminate redundancy between state and federal
2.4regulations, including perceived and real barriers to realizing reduction or elimination
2.5of redundancy;
2.6(6) identify the current strategic decision making of the agencies individually and
2.7collectively to cooperate and coordinate in rulemaking and rule implementation to achieve
2.8more effective, efficient, and justifiable rules that result in the desired outcomes; and
2.9(7) identify the rule assessment and evaluation process that supports the continuation
2.10of the various rules in whole or in part, including but not limited to:
2.11(i) nondegradation standards;
2.12(ii) consistent buffer requirements;
2.13(iii) zoning setback requirements; and
2.14(iv) water quality requirements.
2.15(d) The technical advisory group must submit the study results to all state agencies
2.16with representatives on the technical advisory group and to the chairs of the legislative
2.17committees having primary jurisdiction over environment and natural resources policy
2.18no later than January 15, 2011."
