1.3    "Sec. 45. BUY AMERICAN/BUY LOCAL CERTIFICATION.
1.4(a) No money appropriated in this act may be spent to acquire and better public land
1.5and buildings and make other improvements of a capital nature until the commissioner of
1.6management and budget receives a certification from the entity to whom the appropriation
1.7was made that: (1) all iron, steel, and manufactured goods to be purchased are produced
1.8in the United States and obtained through local suppliers and manufacturers; and (2)
1.9preference will be given to the employment of local workers when workers are hired
1.10in connection with the project.
1.11(b) The certification required in paragraph (a) is not required if the entity certifies to
1.12the commissioner of management and budget before any money appropriated by this act
1.13is spent that: (1) the iron, steel, and other relevant goods are not produced in the United
1.14States and this state in sufficient and reasonably available quantities of satisfactory quality;
1.15or (2) requiring iron, steel, and manufactured goods produced in the United States and this
1.16state will increase the overall cost of the project by more than 15 percent.
1.17The entity must also publish the certificate under this paragraph in the State Register
1.18promptly after it is submitted to the commissioner."
