1.4 Subdivision 1.
Option for filling vacancies; special election in 30 to 90 days.
1.5 Except as provided in subdivision 3, a vacancy in the office of county commissioner may
1.6be filled as provided in this subdivision
and subdivision 2, or as provided in subdivision 4.
1.7If the vacancy is to be filled under this subdivision
and subdivision 2, it must be filled at
1.8a special election
not less than 30 nor more than 90 days after the vacancy occurs. The
1.9special primary or special election may be held on the same day as a regular primary or
1.10regular election but the special election shall be held not less than 14 days after the special
1.11primary.
The county board may by resolution call for the special election to be held as
1.12soon as practicable following the declaration of vacancy, but not less than 12 weeks before
1.13the next regularly scheduled primary election; at an election held concurrently with the
1.14next regularly scheduled primary and general elections; or at an election held no sooner
1.15than 120 days following the next regularly scheduled general election. The person elected
1.16at the special election shall take office immediately after receipt of the certificate of
1.17election and upon filing the bond and taking the oath of office and shall serve the remainder
1.18of the unexpired term. If the county has been reapportioned since the commencement of
1.19the term of the vacant office, the election shall be based on the district as reapportioned.
1.20 Sec. .... Minnesota Statutes 2008, section 375.101, subdivision 4, is amended to read:
1.21 Subd. 4.
Vacancies of less than one year; appointment option. Except as
1.22provided in subdivision 3, and as an alternative to the procedure provided in
subdivisions
1.23subdivision 1
and 2, any other, a vacancy in the office of county commissioner may be
1.24filled by board appointment at a regular or special meeting. The appointment shall be
1.25evidenced by a resolution entered in the minutes and shall continue until an election is
1.26held
under this subdivision. All elections to fill vacancies shall be for the unexpired
2.1term. If one year or more remains in the unexpired term, a special election must be held
2.2under subdivision 1.
If less than one year remains Regardless of the time remaining in
2.3the unexpired term, the county board may appoint a person to fill
