1.3an exception for continuing education requirements for licensed professional counselors;
1.4amending Minnesota Statutes 2008, section 148B.54, by adding a subdivision.
1.5Reported the same back with the following amendments:
1.6Page 1, after line 5, insert:
1.7 "Section 1. Minnesota Statutes 2008, section 148.10, is amended by adding a
1.8subdivision to read:
1.9 Subd. 1b. Conviction of a felony-level criminal sexual conduct offense. (a)
1.10The board may not grant a license to practice chiropractic to any person who has been
1.11convicted of a felony-level sexual conduct offense.
1.12(b) A license to practice chiropractic is automatically revoked if the licensee is
1.13convicted of a felony-level criminal sexual conduct offense.
1.14(c) A license that has been denied or revoked pursuant to this subdivision is not
1.15subject to chapter 364.
1.16(d) For purposes of this subdivision, "conviction" means a plea of guilty, a verdict
1.17of guilty by a jury, or a finding of guilty by the court, and "criminal sexual conduct
1.18offense" means a violation of sections 609.342 to 609.345 or a similar statute in another
1.19jurisdiction."
1.20Page 1, line 9, delete "
initially licensed in 2004" and insert "
issued a license as
1.21a professional counselor on November 1, 2004, and whose license was terminated on
1.22February 20, 2009"
1.23Renumber the sections in sequence and correct the internal references
1.24Amend the title as follows:
1.25Page 1, line 2, after the semicolon, insert "denying chiropractic license to a person
1.26convicted of a felony-level sexual conduct offense;"
1.27Correct the title numbers accordingly
2.1 With the recommendation that when so amended the bill be returned to the
2.2Committee on Health Care and Human Services Policy and Oversight.
