1.2Delete everything after the enacting clause and insert:
1.3 "Section 1. Minnesota Statutes 2008, section 256L.07, is amended by adding a
1.4subdivision to read:
1.5 Subd. 8. Temporary eligibility for unemployed individuals. (a) Any individual
1.6receiving unemployment benefits under chapter 268 and who continues to meet the
1.7definition of "unemployed" in section 268.035, subdivision 26, and members of the
1.8individual's household, are eligible for MinnesotaCare, and are exempt from any
1.9other eligibility criteria in this chapter, for the period specified in paragraph (d). The
1.10commissioner of employment and economic development shall provide written notice
1.11of this eligibility change to all individuals receiving unemployment benefits. Individuals
1.12eligible under this subdivision shall receive coverage for health services as specified
1.13under section 256L.03, except that the annual limit on inpatient hospital services in
1.14section 256L.03, subdivision 3, shall not apply. Individuals eligible under this subdivision
1.15shall receive coverage on a fee-for-service basis with state-only funds, and are exempt
1.16from managed care enrollment under section 256L.12. The commissioner of human
1.17services shall seek federal approval for matching funds within 30 days of the effective
1.18date of this subdivision.
1.19(b) Individuals eligible under this subdivision, and members of the individual's
1.20household, are exempt from MinnesotaCare premiums under section 256L.15 for the
1.21period specified in paragraph (d), but are subject to the cost-sharing requirements specified
1.22in section 256L.03, subdivision 5.
1.23(c) An individual requesting health benefits under this subdivision must provide to
1.24the commissioner of employment and economic development, in the form and manner
1.25specified by that commissioner, information necessary for the commissioner of human
1.26services to provide health benefits under MinnesotaCare to the individual and the
2.1individual's household. The commissioner of employment and economic development
2.2shall transfer this information to the commissioner of human services.
2.3(d) Individuals and household members are eligible under this subdivision until the
2.4earlier of the date upon which the individual is no longer eligible for unemployment
2.5benefits or the date upon which the individual exhausts employment benefits, subject to a
2.6maximum time period of six months. Individuals and household members who are no
2.7longer eligible under this subdivision may reapply for MinnesotaCare. All eligibility and
2.8other requirements of this chapter shall apply at the time of reapplication.
2.9(e) This subdivision expires July 1, 2011.
2.10EFFECTIVE DATE.This section is effective July 1, 2009.
